如上所报导，那打人凶手对那女司机说，“信不信我弄死你”。如今在很多新闻报道中都可发现，“信不信我弄死你”这句话，已经成了很多人的口头禅。也不知究竟是谁赋予了他们生杀大权？

Battery Basics

In both criminal and civil law, "battery" is the intentional touching of, or application of force to, the body of another person in a harmful or offensive manner (and without consent). 那流氓还有一条罪名："attempted hijacking of a bus"。如果他劫车的企图得逞，不知他还会做出什么丧心病狂的事情来（他已经说过“信不信我弄死你”），还不知会导致什么严重后果。而且，他即使会开小汽车，也未必能操纵好大型公共汽车。这将对民众的生命和公共财产构成严重的危险。

男子企图抢夺钥匙发动车 女司机尽全力阻止
当那名男子对女司机孙连连进行殴打时，这辆停在马路中间的522路公交车引起了其他过路公交司机的注意。惊慌之中，观察到车外的情况，孙连连当即大声救命。呼救声被219路公交车司机和54路公交车司机听到，他们纷纷前来救助。
该男子见状，更加肆无忌惮地掐住孙连连的脖子，用力把她从驾驶员座位上拽下去，自己坐上驾驶座，企图发动公交车逃跑，致使车子开始倒退。就在这万分紧急的时刻，伤痕累累的孙连连拼尽全力爬了起来，迅速拉起手刹，关闭了总电源，不顾一切地阻止那名男子发动车子。
打人男子依然不依不饶，毫不顾忌车辆的安全，将公交车的手刹放了下来，致使又向后倒退了一段距离。千钧一发之际，孙连连奋力阻止那名男子的行为，她把手刹重新拉起，极力保证车辆安全。就在此时，那名男子找到了公交车钥匙，准备重新发动车辆逃跑，孙连连又一次进行了阻止，并趁机打开了公交车门。目睹男子疯狂行为的另外两名过路公交司机立即上车，合力将男子制服。孙连连赶忙用手机报警。

那流氓毒打弱女子时穷凶极恶，但被一位男司机一招锁喉之后，马上就㞞了！

是的，她的确是位勇敢的天使。从视频中可以看到，她自始至终还头脑十分清醒、冷静，应对举措十分恰当。

殴打弱小者，尤其是殴打女子，自古以来都是为人所不齿的。在视频最后看到那打人凶手被见义勇为的男司机一招制服，又像一条死狗似的被拖下了车，真是大快人心！

据以上报道，京都律师事务所某律师认为，“伤人者的行为尚不构成刑事犯罪，... 对伤人者处以行政拘留的处罚符合我国法律相关规定”。请问，那打人者的行为包括 assault and battery plus attempted carjacking 等，难道还不构成刑事犯罪？这种律师是哪里培养出来的？

此报道中还说，“一知情人士向新京报记者透露，打人者疑患有精神疾病，目前已送往第三方医院进行精神鉴定”。鉴定结果尚未出来，就急于透出这种风来，不能不说这是一种十分不严肃的做法。从那嫌犯打人时的监控录像看，他哪里有一点儿像是精神疾病患者？

I agree, Yueyin. The guy got off easy. Over here, not only would he likely face criminal charges, there would be a civil lawsuit filed against him.

你说得对。你前面已经提到，Offenders may face both civil liability and criminal charges for a single act (assault and battery)。苏州那个打人凶手，不但已经把那女司机打伤，而且已经坐上了驾驶座，企图发动引擎劫车逃跑。不过他要是能通过什么手段搞来一纸精神病患者证明，他甚至连拘留都不会被拘留。

我前面提到的那个 Cumberland man，他甚至连汽车都没能进入，却因 attempted carjacking 被判10年监禁。看来真正没有王法的是 Cumberland。
