OVERVIEW:
Recently in Africa there is a coordinator effort by organisations claiming to be protecting the rights of the family and American evangelicals to spread hate in the region and they have gotten the political support of certain individuals and organisations in the region. They have gathered amazing support and raised huge amounts of money and have mobilized themselves to Africa to achieve their aims.
A clear example of their efforts is the new anti same sex marriage law in Nigeria and the hate bill that was passed in Uganda but was recently struck down by a court of law and also the evidence of certain policy makers in other countries in Africa threatening to introduce similar bills as well.
Organisations working with and for LGBTQ people including sex workers have been strategizing on how to deal with this recent challenge and hurdle they are faced with. I believe this session would be of great interest to activists and organization with LGBTQ people and sex workers as this session would provide them with the opportunity to brainstorm, analyze the recent situation of things and strength of Christian fundamentals who are sponsoring this new tide of hope and look at how to work in solidarity to deal with all of these challenges.
In the African region we can admit that certain actions that takes place in other country indirectly or directly infleunces the other countries and such is the case with the anti gay laws that have been adopted in Nigeria and Uganda and with other countries threatening to adopt same. This has become a hot and controversial political topic. The movement in Africa needs the opportunity to discuss about these things, device new strategies in dealing with them and adopt new practices for the work they do so as to ensure the advancement of human rights for LGBTQ people and sex workers in the region.
The actualization of this sessions provides an opportunity for participants present to be very visible with their identities and create a formidable solidarity force that helps push the movement forward in Africa and this ultimately contributes to the conferences Theme of; “Visibility in our identities, solidarity in We! Power”.

Hivi karibuni kumekuwa na uratibu wa juhudi za pamoja miongoni mwa mashirika yanayohubiri kasumba za Marekani huku Afrika na yanayodai kulinda haki za familia katika kueneza chuki ndani ya kanda hii na wameonekana kupokea msaada wa kisiasa kutoka kwa baadhi ya watu binafsi na mashirika fulani katoka kanda hii. Mashirika haya yamejijenga na kupata msaada mkubwa mbali na kujipatia kiasi kikubwa cha fedha kwa kujihamasisha wenyewe kwa wenyewe ndani ya kanda ya Afrika kwa ajili ya kuafikia malengo yao.
Mfano wa wazi wa juhudi zao ni kupitishwa kwa sheria inayopambana na ndoa za watu wa jinsia moja nchini Nigeria pamoja na muswada wa chuki uliopitishwa nchini Uganda, ingawa ulitupiliwa mbali na mahakama hivi karibuni, pamoja na ushahidi wa baadhi ya watunga sera wanaotazamia kuanzisha misuada mingine sawa na hiyo katika nchi nyingine za Afrika.
Mashirika yanayofanyakazi na, ama kwa ajili ya watu wa LGBTQ ikiwa ni pamoja na wafanyabiashara wa ngono wamekuwa wakipanga mikakati ya kukabiliana na changamoto hii ya hivi karibuni, na matatizo mengine wanaokabiliwa nayo. Naamini kikao hiki kitakuwa na manufaa makubwa kwa wanaharakati hawa na shirika la watu wa LGBTQ pamoja na wafanyabiashara wa ngono kwa ajili ya kuwapa uwezo wa kuchambua masuala haya kwa kina zaidi na kuwatia motisha wa kupambana na wanasiasa wenye nia mbaya pamoja na ile misingi ghushi ya kikristo ambayo inadhamini hili wimbi mpya. Wanaharakati hawa watafanikiwa kwa kufanya kazi kwa njia ya mshikamano ili kukabiliana na hizi changamoto zote.
Tunaweza kukubali kwamba Katika kanda ya Afrika, baadhi ya matendo yanayofanyika katika nchi moja yanaweza kuathiri matendo ya nchi nyingine kwa njia moja au nyingine jinsi ilivyothihirika kwenye sheria ya kupambana na watu wenye mvuto wa mapenzi ya jinsia moja ambayo ilikubaliwa nchini Nigeria na Uganda na sasa yatishia kupitishwa katika nchi nyingine za Afrika.
Hii ndiyo imekuwa mada kuu na tata zaidi katika anga za kisiasa. Harakati za vuguvugu hili ndani ya kanda ya Afrika zinahitaji nafasi ya kujadili mambo haya kwa kina, uundaji wa mikakati mwafaka ya kukabiliana na changamoto hili pamoja na kubuni mbinu mpya za kuhakikisha uendelezaji mufti wa haki za binadamu kwa watu wa LGBTQ pamoja na wafanyabiashara wa ngono ndani ya kanda hii.
Matarajio ya kikao hiki ni kutoa fursa kwa washiriki wote walioko, kuwa na maono mazuri kwenye utambulisho wao ili kujenga mshikamano thabiti na ambao utasaidia kuzipa harakati za vuguvugu hili nguvu zaidikatika kanda ya Afrika hivi kwamba hatimaye kuwepo na mandhari mazuri katika mikutano ya; " Mwonekano katika utambulisho wetu , mshikamano ndani ya nguvu yetu!

INTRODUCTION
Due to the presence of many organizations in Dar es Salaam that have been covering and providing services to the vulnerable groups, including sex workers and MSM, the situation in the provinces has changed significantly. Conditions of access to education have been very difficult and so have been getting access to friendly healthy services, condoms and leaflets offering education on how diseases are transmitted sexually and how to protect themselves from the disease.
Statements from the government and the Ministry of Health indicate that various studies have been undertaken. But, these studies were only done in Dar es Salaam and regions which showed high levels of HIV infection rates, forgetting other provinces where there are large numbers of these groups of Sex Workers.
Tanga province in the national data on prevalence of HIV has 5.0 percent% in position ten followed by Tabora 5.1% in ninth place let alone in the national statistics where it’s 5%, MSM is 42-45% and sex workers is 31-35%, that is in the report of the Ministry of Health through the National Aids Campaign Program (NACP) in the third strategic plan to combat the prevalence of HIV NMSF III 2013 / 14-2017 / 18. From the analysis of various reports, organizations such as Stay Awake Network Activities that was Tanzania Sisi kwa Sisi Foundation which is headquartered in Dar es Salaam has been committed towards helping the targeted groups in Dar es Salaam while those in the provinces stay neglected.
BACKGROUND INFORMATION
KBH Sisters will use the method of training to reach the target audience and introduce some centers offering friendly services in partnership with government and private stations in Tanga province supported by the participation of the POLICE Gender desk in solving the problems and challenges of gender and sexual violence that exist among sex workers. Due to an increased number of sex workers in Tanga province, the continuous maintenance of cultures & traditions has put the lives of young girls at stake especially when the reach the age of puberty. This has driven most of them towards engaging in commercial sex at an early age.
This increase has led to the risk of most of them being infected mostly due to lack of friendly services and accurate information about sexual reproductive health rights for some of the girls who have reached the age of puberty. They have been receiving inaccurate information leading to indulgence in sexual activity at an early age.
Participation in the form of access to information on the development of their health by choosing representatives who will be peer educators, and who will provide progress reports on the performance and how to reach them and provide them with education and information relating to sexual reproductive health rights and development, self knowledge, HIV and AIDS and STI emphasizing on how to access services in suggested friendly healthcare centers in Tanga province.
PROBLEM STATEMENT
There has been misinformation and continuation of some customs and traditions among the tribes in the province of Tanga. When young girls reach the age of puberty they are only taught and directed on how to live and care for a man; without being informed about matters reproductive health and development, self knowledge on identity and knowledge about sexually transmitted diseases, AIDS and sexual education.
This is due to lack of health facilities that provide these services and instructions on how a woman can protect and defend herself. Even when she has decided to engage in commercial sex she stills lacks the directions on how to get accurate and useful information on the proper use of protection from contracting HIV, and sexually transmitted diseases.
According to national statistics on the state of HIV infection, the root of the problem is the presence of fish trade and also the association with the neighboring coastal region of Kenya, Mombasa. The existence of poor health services has also resulted in the challenges of some of the sex workers’ inability to access services.
There has been a deplorable state in terms of accessibility of healthcare services due to an increase in the number of employees abandoning their duties, leading to the absence of basic services such as roads and water. This happened even with the existence of the Benjamin William Mkapa HIV/AIDS Foundation that offered to build up houses for employees in different provinces of Tanzania. Some of these houses were inaugurated last year by the incumbent President. Hon. Dr. Jakaya Mrisho Kikwete. Access to healthcare services has been a major challenge leave alone friendly services for the vulnerable groups, including MSM and sex workers whose numbers have continued to grow day by day.
Because of this situation, sex workers have been missing out on various types of important services, and even getting essential health reports has been also been a challenge. To organize training and facilitate the participation of the government through its representatives in the AIDS departments of the district and province levels. This will include the Secretary of Aids Location, District and Province in collaboration with organizations involved with service delivery on HIV infections and organizations that fight sexual and gender violence. (Eg NACOPHA- National Council for People Living with HIV and AIDS, TGNP- Tanzania Gender Network Program, Gender Desk TPGD Police and others)
Organizing community participation by using existing programs or developing strategies specifically related to the issues of HIV and sexual violence among governmental and non-governmental organizations operating in the province of Tanga.
Capacity building for peer educators who will be representatives in Tanga province, so as to enable them to work together with the concerned public agencies and private actors in region. This way, they’ll be able to reach out to the beneficiaries of the program and give them an opportunity to access healthcare services from suggested friendly health centers.
OBJECTIVES
1. Providing sex workers in Tanga province self knowledge, knowledge of reproductive health and sexuality, HIV and AIDS, and other sexually transmitted diseases
2. Providing sex workers with knowledge on the proper use of condoms and that knowledge to be provided by peer educators on a continuous process even after training has been completed in conjunction with existing organizations that are concerned with service delivery to vulnerable groups, including sex workers
3. Generating the sex worker's ability to cooperate with government and private organizations in demanding for their basic human rights, including the right to get the best and rightful service which they are eligible for without discrimination and stigmatization.
4. Provide training to enable them to become ambassadors and representatives of all the sex workers in Tanga province in order to defend their rights whenever they are faced gender and sexual violence.
5. Build a bridge between the public, private organizations and various partners who provide healthcare services in protesting sexual violence in the province of Tanga so as to continue the implementation of this work. This will enable sex workers to work freely without being faced with the threat of sexual violence, sexually transmitted diseases and AIDS.

Inviting public agencies and private actors to come and provide knowledge about the services they provide and how sex workers can be able to participate in the fight against HIV, sexual violence and stigmatization.
3. Provide training to become ambassadors and representatives of all sex workers in Tanga province in order to defend their rights whenever they are faced with gender and sexual violence challenges.
Recommend representatives from the participants who will be peer educators and used in the distribution of condoms and educational leaflets and information on HIV, STIs and sexual violence.
4. Build a bridge between the public, private organizations and various partners who provide healthcare services in protesting sexual violence in the province of Tanga so as to continue the implementation of this work. This will enable sex workers to work freely without being faced with the threat of sexual violence, sexually transmitted diseases and AIDS.
Involving the gender desk of the police to give instructions and suggestions on how to deliver services and techniques of getting services.
Identifying partners of the fight against HIV and who oppose sexual violence and how they can obtain information on instances of sexual violence, and how the sex workers living with HIV can access the friendly healthcare service and without stigmatization.

Kutokana na kuwepo kwa Asasi nyingi Dar es Salaam ambazo zimekuwa zikijihusisha na kutoa huduma kwa makundi maalumu yakiwemo sex workers na MSM hali huko mikoani mambo yamekuwa tofauti. Hali ya upatikanaji wa elimu umekuwa wa shida sana na pia upatikani wa huduma kama huduma rafiki ya Afya, Kondom na vipeperushi vya namna magonjwa ya ngono yanavyoambukizwa na namna ya kujikinga na magojwa.
Matamko mengi ya serikali na wizara ya Afya yamekuwa yakifanya tafiti mbalimbali lakini katika matekelezo ya tafiti hizo yamekuwa yakifanyikia Dar es Salaam na mikoa ambayo imeonekana kuwa na takwimu za juu zenye maambukizi ya ukimwi wakisahau mikoa mingine ambapo kuna idadi kubwa ya makundi haya ya Sex workers.
Mkoa wa Tanga katika Takwimu za kitaifa katika Maambukizi ya ukimwi ina asilimia 5.0% na umeshikilia nafasi ya kumi ikifuatiwa na Tabora 5.1% katika nafasi ya tisa achilia mbali katika takwimu za taifa ni asilimia 5% ambapo MSM ni 42-45% and sex workers ni 31-35%, hiyo ni katika ripoti ya wizara ya Afya kupitia National Aids Campaign Program (NACP) kwenye mpango mkakati wa tatu wa kupambana na maambukizi ya virusi vya ukimwi NMSF III 2013/14-2017/18. Kutokana mchanganuo huo wa Taarifa mbalimbali mashirika kama Stay Awake Network Activities na iliyokuwa Tanzania Sisi kwa Sisi Foundation ambayo makao yake makuu yapo Dar Es Salaam wamejikita katika kuwasaidia walengwa wanaopatikana ndani ya Dar es Salaam huku walioko mikoani wakiwa wanabaki bila msaada.
UTANGULIZI
KBH Sisters itatumia njia ya mafunzo kuwafikia walengwa na kutambulisha baadhi ya vituo vinavyotoa huduma rafiki kwa kushirikiana na serikali na vituo binafsi katika mkoa wa Tanga ikisindikizwa na ushirikishwaji wa dawati la Jinsia la POLICE kutatua matatizo na changamoto za ukatili wa kijinsia na kingono ulioko miongoni mwa sex workers. Kutokana na kuwepo ongezeko la sex workers katika mkoa wa Tanga ilihali mila na desturi zikiendelea kudumishwa na mabinti wadogo wameendelea kuchezwa wanapofikia umri wa kuvunja ungo (maturing age) na kuwapelekea wengi kujiingiza katika biashara ya kazi za ngono katika umri mdogo. Ongezeko hili limepelekea kuwepo kwa hatari ya wengi wao kupata maambukizi kutokana na kukosekana kwa huduma rafiki na taarifa sahihi za haki ya afya ya uzazi na makuzi (sexual reproductive health rights) kwa baadhi ya mabinti wanaokuwa wamefikia umri wa kuvunja ungo. Wamekuwa wakipata taarifa zisizo sahihi na kupelekea kujiingiza katika kazi ya ngono katika umri mdogo.
Ushirikiswaji wa namna ya kupata huduma za taarifa za maendeleo ya afya zao kwa kuchagua wawakilishi ambao watakuwa ni waelimishaji rika ambao watakuwa wanatoa taarifa za maendeleo katika utendaji na namna ya kuweza kuwafikia na kuwapatia elimu na taarifa mbalimbali zinazohusu masuala ya haki ya afya ya uzazi na makuzi, elimu ya kujitambua, VVU na UKIMWI na magonjwa ya ngono ikizingatiwa namna ya kuweza kupata huduma rafiki katika vituo pendekezi mkoani Tanga.
TAARIFA YA TATIZO
Kumekuwa na upotoshaji wa taarifa na pia kumekuwa na kuendelea kwa baadhi ya mila na desturi miongoni mwa makabila katika mkoa wa Tanga. Mabinti wanapofikia umri wa kuvunja ungo hufundishwa na kuelekezwa namna ya kuishi na kumhudumia mwanaume bila kuwepo na taarifa sahihi za elimu juu ya afya ya uzazi na makuzi, elimu ya kujitambua na elimu juu ya magonjwa yatokananyo na mgono, ukimwi na elimu ya ujinsia.
Hii nikutokana na kutokuwepo vituo vya afya vinavyotoa huduma hizi na maelekezo ya namna mwanamke anavyoweza kujikinga na kujilinda. Hata pale anapojikuta ameamua kujihusisha na kazi ya ngono amekuwa akikosa mwanga wa maelekezo wa namna ya kupata taarifa sahihi na muhimu juu ya matumizi sahihi ya vitendea kazi vya kujilinda na kujikinga na maambukizi ya ukimwi, na maradhi yanayotokana na ngono.
Kulingana na Takwimu za kitaifa za hali ya maambukizi ya ukimwi na kuwepo kwa biashara ya samaki na pia kuwepo kwa mungiliano na nchi jirani ya Kenya kwenya mwambao wa pwani wa Mombasa. Kuwepo kwa huduma hafifu za afya pia imepelekea kuwa na changamoto za upatikanaji wa huduma kwa baadhi ya sex workers.
Kumekuwa na hali mbaya katika upatikanaji wa huduma za afya kutokana na ongezeko la waajiriwa kukimbia katika maeneo yao ya kazi kupelekea na kutokuwepo kwa huduma za msingi kama barabara na maji, achilia mbali kuwepo kwa Benjamini Wiliam Mkapa HIV/AIDS Foundation ambapo ilijitolea kiujenga nyumba za wafanyakazi katika Mikoa mbalimbali ya Tanzania baadhi zilizinduliwa mwaka jana na Raisi aliyeko madarakani Ndug. Mhe. Dkt. Jakaya Mrisho Kikwete upatikanaji wa huduma umekuwa ni changamoto achilia mbali huduma rafiki kwa ajili ya makundi maalumu wakiwemo MSM na sex workers ambao idadi yao imeendelea kuongezeka siku hadi siku.
Kuwepo kwa hali hiyo Sex workers wengi wamekuwa wakikosa huduma mbali mbali hata upatikananji wa Taarifa muhimu za afya imekuwa ni changamoto. Kwa kuandaa mafunzo na kuwezesha ushirikishwaji wa serikali kupitia wawakilishi wake katika ngazi za wilaya na mkoa kwenye vitengo vya ukimwi wakiwemo Katibu wa Ukimwi Kata, Wilaya na Mkoa kwa kushirikiana na mashirika yaliyopo yanayojuhusisha na utoaji huduma juu ya maambikizi ya ukimwi na mashirika yanayopinga ukatili wa kijinsia na kingono. (mfano NACOPHA- National Council for People Living with HIV and AIDS, TGNP- Tanzania Gender Network Program, Dawati la Police la Jinsia TPGD na mengineyo)
Kuandaa ushirikishwaji wa jamii kwa kupitia mipango mikakati iliyopo au inayoendelea hasa inayohusu masuala ya ukimwi na ukatili wa kijinsia miongoni mwa mashirika ya kiserikali na yasiyokuwa ya kiserikali yanayofanya shughuli zake ndani ya mkoa wa Tanga.
Kuwajengea uwezo waelimisha rika watakaoukuwa wawakilishi katika mkoa wa Tanga kuwa na muingiliano katika utendaji na mashirika ya umma na binafsi ilikuweza kuwafikia wahusika kwa usahihi na ufanisi na kuweza kuwapa fursa ya kuweza kupata huduma katika vituo pendekezi vitakavyobainishwa kutoa huduma rafiki.
MALENGO
1. Kuwapatia sex workers wa mkoa wa Tanga elimu ya kujitambua, elimu ya afya ya uzazi na ujinsia, UKimwi na VVU, na magonjwa yatokanayo na ngono.
2. Kuwapatia sex workers elimu ya matumizi sahihi ya ya kondom na elimu hiyo kuweza kutolewa na waelimisha rika katika muendelezo hata baada ya mafunzo kuisha kwa kushirikiana na mashirika yaliyopo na yanayojihusisha na utoaji huduma kwa makundi maalumu wakipepo sex workers
3. Kuwajengea sex workers uwezo wa kuweza kushirikiana na serikali na mashirika binafsi katika kudai haki zao za msingi zikiwemo haki za kupata huduma bora na stahiki bila kubaguliwa na kunyanyapaliwa.
4. Kuwapatia mafunzo ya kuweza kuwa mabalozi na wawakilishi wa sex worker wote katika mkoa wa Tanga kutetea haki zao pale wanapopata changamoto za ukatili wa kijinsia na kingono.
5. Kujenga daraja baina ya serikali na mashirika binafsi na wabia mbalimbali wanaotoa huduma za afya na kupinga ukatili wa kijinsia ndani ya mkoa wa Tanga kuweza kuweka muendelezo wa utekelezaji wa kazi hii ili kuwa na sex workers walio salama dhini ya ukatili na magonjwa ya ngono na ukimwi.

Abstract
Kenya's legal ecosystem and its accommodation of the needs and issues of transgender people are two highly misunderstood areas of law demanding critical analysis using case precedents from Kenya's judicial system. This presentation will analyze four court rulings and one administrative action by the Commission for Administrative Justice (CAJ). The court cases touch on issues relating to the right to register a transgender association, the right to change names and gender marks in academic certificates, violation of rights of among transgender women during arrests and the State's role in developing policies and guidelines to enable transgender people access health care services in Kenya.
The presentation will further analyze case precedents from other jurisdictions and how they can be grafted on our approaches to seek redress for violations and abuses. The timing and nature of these case precedents and the significant consequences they have had on the growth of transsexual jurisprudence in Kenya will be discussed.
This presentation will further look into paradigms that are detrimental to pro-transgender legal and policy initiatives and how such need to be addressed – both in transgender and cisgender communities. Complementary advocacy and sensitization initiatives that could work in synergies with public interest litigation will be recommended.

Mada hii inatazamia kuchambua maamuzi manne ya mahakama na mojawapo ya hatua za kiutawala iliyochukuliwa na Tume ya Sheria za Utawala (CAJ ). Kesi hizi zinagusia masuala yanayohusiana na haki ya kujiandikisha kama chama cha watu wenye jinsia tofauti na asili, haki ya kubadilisha majina na alama ya jinsia kwenye vyeti vya kitaaluma, ukiukwaji wa haki za wanawake wenye jinsia tofauti na jinsia asili wakati wanapokamatwa na polisi pamoja na jukumu la sheria za nchi katika kuendeleza sera na miongozo mizuri inayowawezesha watu wenye jinsia tofauti na asili kupata huduma bora za afya.
Mada hii pia itazidi kuchambua kesi za matukio ya mbeleni kutoka kwa mamlaka nyingine na jinsi inavyoweza kutumika kwa kupandikizwa juu ya mbinu zetu za kusuluhisha masuala ya kisheria ili kupata njia mwafaka za kutatua shida za dhuluma na ukiukwaji wa haki za binadamu. Asili na majira yanayohusishwa na kesi hizi za matukio ya mbeleni pamoja na madhara yao kwenye ukuaji wa sheria za watu wenye jinsia tofauti na asili yatajadiliwa.

Introduction/ Background
The last two years have brought a new wave of criminalization among the LGBTI community in Uganda. Uganda has introduced new criminalization laws that are harsh, draconian and are violating human rights and dignity. Though now annulled by the high court of Uganda, the Anti Homosexuality Act just like the Anti Pornography Act passed by the Uganda Parliament in 2013 have intensified discrimination and stigma among trans-women and trans-sex workers and other LGBTI groups.
As a result of criminalization, coupled with stigma and discrimination, transgender women and transgender sex workers continue to face crisis levels of STI infection including HIV, and are less likely to access quality, timely and non discriminatory SRH services and information. Globally, transgender women and transgender sex workers are 19 times more likely to contract HIV than other people.
Program Description
Transgender Equality Uganda (TEU) is a transgender sex worker organization founded and run by transgender sex workers with core mandate of creating a Ugandan society that respects and upholds the rights of transgender women and transgender sex workers, supports the economic empowerment of this marginalized population, and recognizes their equal-access to confidential, quality and improved health care services.
TEU is currently implementing a Trans-women health care program that aims at advocating for quality, confidential and non discriminatory sexual reproductive health care services and information that meet the health needs and aspirations of the trans-women and trans-sex workers. The program seeks to empower them with accurate comprehensive sexuality education with an aim of enabling them to make the right choices and decisions that concern their bodies and health. The program links up and facilitates referrals of trans-women and trans-sex workers to specific health care facilities that provide non discriminatory and confidential SRH services including HIV services.
Lessons Learnt
Trans-women and transgender sex workers are isolated and denied the right to access non discriminatory and confidential SRH and HIV/AIDS services from skilled health care and they have challenges reaching health centers and accessing health services. Available services designed for the most at risk populations do not meet the needs of trans-women and trans-sex workers which affect their health seeking behavior and often times they have experienced poor attitude by health workers. They also luck access to consumables like; condoms, lubricants and hormonal replacement therapy yet these are the most pressing needs of trans-women. There is also lack of accurate information on sexual reproductive health and rights. They also face stigma and discrimination subjected from the transphobic and homophobic communities rendering many into sex work.
Next Steps and Recommendations,
Tailoring the needs and the available Sexual Reproductive Health and HIV/AIDS services to meet and address the needs of trans-women and trans-sex workers will enhance their uptake for prevention and cares services and consequently reduce the impact of HIV/AIDS on this vulnerable and most at risk population. It is very critical that the transgeder women and transgender sex workers are mobilized to meaningfully contribute to the National SRH and HIV/AIDS programming and implementation processes.

Kwa miaka miwili iliyopita sasa kumekuwa na wimbi jipya la kutunga sheria kali miongoni mwa jamii ya LGBTI ya Uganda. Uganda imeanzisha mtazamo wa kutunga sheria mpya ambazo ni kali, za kibabe na zinazokiuka heshima na haki za binadamu. Ingawa Sheria za Kupambana na Mvuto wa mapenzi ya jinsia moja na ile ya kupinga upeperushaji wa filamu zenye picha za ngono zilizopitishwa na Bunge la Uganda mwaka 2013 zilitupiliwa mbali na mahakama kuu ya uganda, sheria hizi zimeendeleza kasumba ya ubaguzi na unyanyapaa dhidi ya wanawake wenye jinsia tofauti na asili na wanaume wenye jinsia tofauti na asili pamoja na makundi mengine ya LGBTI.
Kwasababu ya kutunga sheria hizi za kibabe pamoja na unyanyapaa na ubaguzi, wanawake wenye jinsia tofauti na asili na wafanyabiashara wa ngono wenye jinsia tofauti na asili wanaendelea kukabiliwa na mgogoro wa changamoto ya maambukizi ya magonjwa ya zinaa ikiwa ni pamoja na VVU, na uwezo wa kiwango cha chini wa kupata habari pamoja na huduma bora, na zisizo za kibaguzi kutoka kwa SRH. Kimataifa, wanawake pamoja na wafanyabiashara wa ngono wenye jinsia tofauti na asili wanauwezekano wa kiwango cha takribani mara19 zaidi cha kuambukizwa ugonjwa VVU kuliko watu wengine.
Maelezo ya Mpango
Transgender Equality Uganda (TEU ni shirika la watu wenye jinsia tofauti na asili la Uganda ambalo lilibuniwa na wafanyabiashara wa ngono wenye jinsia tofauti na asili na ambao wana mtazamo wa kuzingatia msingi wenye mamlaka ya kujenga jamii moja ya Uganda ambayo inaheshimu haki za wanawake pamoja na wafanyabiashara wa ngono wenye jinsia tofauti na asili, pia shirika hili linawezesha idadi hii ndogo, ya watu wanaodhulumiwa, kujikimu kiuchumi, vilevile linatambua kuwa wana uwezo-sawa wa kupokea huduma bora za afya.
TEU kwa sasa ina malengo ya kuhakikisha kuwa wanawake pamoja na wafanyabiashara wenye jinsia tofauti na asili wanapokea huduma bora za afya, huduma hizo ziwe za siri, na zisizo za kibaguzi hususani kama ni huduma za afya ya uzazi na habari hivi kwamba ziweze kukidhi mahitaji ya afya na matarajio ya wanawake na wafanyabiashara wa ngono wenye jinsia tofauti na asili. Programu hiyo inalenga kuwaelimisha kuhusu njia salama za kujamiiana na kuelewa afya ya miili yao ili waweze kufanya maamuzi mema katika maisha yao. Mpango huu unawezesha wanawake na wafanyabiashara wa ngono wenye jinsia tofauti na asili kupata habari mwafaka kuhusu vituo vya afya ambavyo ni maalumu kwa kutoa huduma za SRH ambazo ni za siri na zisizo za kibaguzi ikiwa ni pamoja na huduma za VVU.
Mambo ya Kujifunza
Wanawake na wafanyabiashara wa ngono wenye jinsia tofauti na asili huwa wanapata changamoto nyingi katika harakati za kupokea huduma za SRH zisizo za kibaguzi na za siri kutoka kwa kwa wahudumu wa afya waliohitimu, mbali na changamoto ya kufikia vituo hivi vya afya ili kupata huduma bora za afya. Mara nyingi huduma iliyouundwa kwa ajili ya kusaidia watu wengi waliohatarini zaidi haina uwezo wa kukidhi mahitaji ya wanawake pamoja na wafanyabiashara wa ngono wenye jinsia tofauti mbali na mtazamo duni wanaopata kutoka kwa wahudumu wa afya. Hali hii inazidi kuzorotesha afya ya wanawake na wafanyabiashara wa ngono wenye jinsia tofauti ambao huzidi kukosa bidhaa muhimu za matumizi kama mipira ya kondomu, mafuta na homoni mbadala ya tiba. Pia kuna ukosefu wa habari sahihi kuhusu afya ya uzazi na haki zake. Vilevile wanakabiliwa na unyanyapaa na ubaguzi kutoka kwa watu wenye chuki dhidi ya jinsia tofauti na asili pamoja na wale walio na ubaguzi dhidi ya mapenzi ya jinsia moja. Jambo hili limewazinikisha wengi kujiingiza katika biashara ya ngono.
Hatua ya Mbeleni na Mapendekezo,
Kuunganisha mahitaji ya afya ya uzazi ya wanawake pamoja na wafanyabiashara wa ngono wenye jinsia tofauti na asili pamoja, kunaweza kusaidia kuimarisha matumizi mazuri ya huduma za afya zilizopo na kupunguza athari za kueneza maambukizi ya VVU/UKIMWI kwa jamii hii ndogo ya watu wanaobaguliwa. Pia ni muhimu kwa wanawake pamoja na wafanyabiashara wa ngono wenye jinsia tofauti na asili kuhamasishwa kujihusisha kikamilifu katika kuchangia kwa SRH za Taifa na taratibu za mipango ya kutekeleza na kupiga vita VVU / UKIMWI.

Description
WAPATE Initiative was established in the year 2011, registered in 2012 by a group of sex worker peer educators with the mission to ensure that sex workers (male and female) enjoy opportunities for increased access to HIV/AIDS and STI healthcare services, protection and promotion of their human rights, and reduction of violence against them. The peer educators formed the group as an immediate response strategy towards reducing the rampant violation of female sex workers health and human rights perpetrated by the public, law enforcement agencies, and healthcare workers. WAPATE initiative’s vision is to see a society where female sex workers have equal opportunities to access HIV/AIDS and STI healthcare services and where their human rights are protected. The organization offers evidence-based HIV and STIs prevention services including peer led health education, awareness creation, distribution of prevention commodities, HIV Counseling and Testing, referrals for HIV/STI screening & treatment, management and care. WAPATE Initiative engage in advocacy processes targeting the police, healthcare workers, and family members of sex workers with the intention of urging them to facilitate the creation of an enabling environment where its 1,600 members can engage in sex work and access to healthcare services and rights protection without stigma and discrimination.
Challenge
Female sex workers in Thika used to face serious human rights violations and violence from the public and police officers. WAPATE Initiative started a solidarity movement among the female sex workers in different hot spots in Thika town and its environs that has enabled them work together to address the challenge.
Methods
WAPATE Initiative conducted a mapping of sex workers hot spots in various parts of Kiambu County to help in targeted service delivery through the mobile and outreach units. The mapping activity generated data of 8,766 female sex workers in over 150 hot spots. Through, this WAPATE Initiative held discussions with sex workers to establish vibrant female sex workers hot spot units and leadership and a strong solidarity among female sex workers in 10 selected hotspots. The solidarity groups’ then started working with police officers from local police stations to foster accountability. This has helped female sex workers from the selected hotspots have been able to address sexual and gender based violence, clients refusing to pay for services rendered, and blackmail issues in a better way. Although, we have not conducted a research to determine the statistics on progress, there is an agreement among sex workers that the solidarity groups have drastically reduced issues of sexual and gender based violence.
Results
Working with the police is a key element of efforts to reduce violence against sex workers.
Sensitizing police officers on the rights of sex workers enlighten police officers and enhance protection of sex workers rights.
There is a better relationship between sex workers and police in order to minimize police harassment and violence.
There is a drastic reduction of violence and human rights violations among sex workers in the units where there are solidarity groups.
Sex workers have started educating each other and ensuring that each one of them is well and safe
The stronger solidarity among sex workers in the selected hotspots have motivated them to start table banking and financial security
Next Steps
WAPATE Initiative is focusing on gaining support at senior levels in the police hierarchy including holding meetings with officer commanding police division and officer commanding police stations to ensure that the police officers in the field are motivated to protect the rights of female sex workers and hold them accountable for their actions.

Waelimishaji rika hawa walibuni kikundi hiki kama mikakati ya haraka ya kupiga vita ukiukwaji wa mara kwa mara wa haki za kibinadamu na afya ya wafanyabiashara wa ngono wa kike unaofanywa na umma, mashirika ya kisheria na wahudumu wa afya. Maono ya Mradi wa WAPATE ni kuwa na jamii inayowapa wafanyabiashara wa ngono wa kike nafasi sawa za kunufaika kutokana na mipango ya kupata huduma za afya za VVU/UKIMWI na magonjwa ya zinaa pamoja na kulinda haki zao za binadamu inavyotakikana.
Shirika hili linatoa huduma zilizothibitishwa za kuzuia maambukizi ya VVU na magonjwa ya zinaa pamoja na mafunzo ya rika yaliyo na mtazamo wa aafya, uhamasishaji, usambazaji wa bidhaa mwafaka za kuzuia maambukizi, kupima na kutoa ushauri nasaha kuhusu VVU pamoja na historia ya matibabu na uchunguzi uliofanywa kuhusu VVU na magonjwa ya zinaa, usimamizi na huduma bora. Mradi wa WAPATE umewashirikisha polisi na wahudumu wa afya, na familia za wafanyabiashara wa ngono katika mchakato wa kuwezesha kuundwa kwa mazingira ya kuwaruhusu wanachama wao 1,600 kufanya biashara ya ngono na kupokea huduma bora za afya pamoja na kulindwa kwa haki zao bila unyanyapaa wala kubaguliwa.
Changamoto
Polisi na umma katika sehemu za Thika wanawadhulumu sana wafanyabiashara wa ngono wa kike mbali na kukiuka haki zao za binadamu. Mradi wa WAPATE ulitathimini ramani ya idadi ya wafanyabiashara wa ngono wa kike katika maeneo hatari sehemu mbalimbali za Kaunti ya Kiambu ili kurahisisha utoaji wa huduma kwa walengwa kupitia vitengo vya kuwafikia na vile vya muda.
Shughuli ya utathimini wa ramani hiyo ilionyesha kuwa kuna jumla ya wafanyabiashara wa ngono 8,766 wa kike katika zaidi ya maeneo hatari 150. Matokeo hayo yaliushinikiza mradi wa WAPATE kuandaa mazungumzo na wafanyabiashara wa ngono wa kike ili kubaini maeneo hatari zaidi kwa yote na uongozi sahihi pamoja na kuhamasisha mshikamano thabiti miongoni mwa wafanyabiashara wa ngono wa kike walio katika maeneo 10 hatari zaidi yaliyochaguliwa.
Mshikamano wa vikundi hivi basi ukaanza kushirikiana na maafisa wa polisi kutoka kwenye vituo vya mitaani ili kuendeleza uwajibikaji. Hili limewezesha wafanyabiashara wa ngono kudhibiti changamoto za ukiukwaji wa haki za binadamu, dhuluma za kijinsia na ngono pamoja na tabia za wateja ghushi wanaokataa kulipia huduma wanazopokea, na usaliti kwa njia bora zaidi. Hata kama hatujafanya utafiti kubaini maendeleo ya takwimu zilivyo, kauli ya pamoja kutoka kwa wafanyabiashara wa ngono ni kwamba makundi ya mshikamano yamesaidia pakubwa katika kupunguza masuala ya unyanyasaji wa ngono na kijinsia.
Matokeo
Kufanya kazi na polisi ni kigezo kikubwa katika jitihada za kupunguza unyanyasaji dhidi ya wafanyabiashara wa ngono. Kuhamasisha maafisa wa polisi kuhusu haki za wafanyabiashara wa ngono kumewaelimisha maafisa hao kuhusu haki za wafanyabiashara wa ngono na jinsi ya kuzilinda.
Kumekuwa na uhusiano bora kati ya wafanyabiashara wa ngono na maafisa wa polisi ili kupunguza visa vya polisi wanaonyanyasa wafanyabiashara hawa wa ngono.
Kumekuwa na upungufu mkubwa wa dhuluma na ukiukwaji wa haki za binadamu dhidi ya wafanyabiashara wa ngono katika sehemu ambazo kuna makundi ya mshikamano.
Wafanyabiashara wa ngono wameitikia mwito wa kuelimishana na kuhakikisha kuwa kila mmoja wao yuko sawa na salama. Mshikamano huuthabiti, umewatia motisha wafanyabiashara wa ngono kujihusisha na mipango ya kuwekea akiba pesa zao ili kujikimu kifedha.
Hatua za mbeleni
Mradi wa WAPATE unalenga kupata uungwaji mkono kutoka kwenye ngazi za juu katika idara ya polisi, ikiwemo kufanya mikutano na kamanda mkuu wa polisi na mkuu wa vituo vya polisi nchini ili kuhakikisha kuwa maafisa wote wa polisi wanaohudumu vituoni wanapata motisha ya kulinda haki za wafanyabiashara wa ngono wa kike na kuwajibika kwa matendo yao vilivyo.

Artistic festival for male and transgender sex workers in Bukavu, RDC: “Advocacy for the protection and care for male and transgender sex workers in Bukavu, RDC”

Background:
Sometimes, wars and conflicts are fertile grounds for sex work. However, we have also realised that male and transgender sex workers have lost their dignity and lives simply because they are male and transgender sex workers.
For this reason, male and transgender sex workers of Bukavu in the Democratic Republic of Congo developed a strategy dubbed “Committee for Solidarity of male and transgender sex workers” for sustaining health and human rights activities within their organisation, AHUSADEC.
In the view of making this advocacy efficient in Africa, male and transgender sex workers have put on the spotlight the silence of the community, the church and the police regarding daily violence against male and transgender sex workers in Bukavu in the backdrop of political instability.
Objective: Encourage male and transgender sex worker organisations and activists to heighten their regional advocacy to support male and transgender sex worker organisations and activists in Eastern DRC.
Duration: 45 minutes
Play:
Male and transgender sex workers will dance as a regional and global advocacy tool to highlights the violence against them. This choreographed dance will be accompanied by speeches and demonstrations of violence against them in Bukavu, RDC. The theme will be: « DR Congo, MSM transgender advocacy exhibition activity ».
Male and transgender sex workers will recite poems in Kiswahili and French about violence they face, which will be followed by a fashion exhibit by male and transgender sex workers in Vitenge. They will act as male and transgender sex workers with violent clients using a violent dance, which will end in sex. It will also highlight the need to involve male and transgender sex workers in decision-making for the protection of all. During this play, three cases will be presented: male and transgender sex workers and community, male and transgender sex workers and healthcare services (VCT, STI clinics, and treatment), male and transgender sex workers and the law.
The activity ends with people screaming dire « DROITS HUMAINS POUR TOUS », « HAKI YA BINA DAMU KWA WOTE », « HUMAN RIGHTS FOR ALL ».
