PRELIMINARIES
1. Short title, extent and commencement. - (1) This Act may be called the National Commission on the Rights of Children Act, 2009.
(2) It extends to the whole of Pakistan.
(3) It shall come into force at once.
2. Definitions.- In this Act, unless there is anything repugnant in the subject or context, the following words and expressions shall have the following meaning;
(a) “Adult” means a person who has completed 18th years of age;
(b) “Commission” means the National Commission on the Rights of Children established under section (5) of the Act;
(c) “The best interests of a child” Where there is a reference in this Act to “the best interests of the child”, the factors to be taken into account in determining the child’s best interests shall include;
(i). the child’s right to be protected from abuse, neglect and harm or threat of harm;
(ii). the welfare, well being and safety of the child;
(iii). the child’s physical and emotional needs and level of development;
(iv). the child’s family to be considered as the preferred environment for the care and upbringing and the responsibility for the protection of the child to rest primarily with the parents;
(v). the quality of the relationship the child has with a parent or other any other person and the effect of maintaining that relationship;
(vi). the child’s religious, cultural and spiritual views;
(vii). the child’s level of education and educational requirements;
(viii). the child is given the opportunity to freely express his own views and opinion and these views are to be given due weight; and
(ix). the effect on the child of a delay in making a decision.
(d) “Child” means a person who has not yet attained the age of 18 years, at the time of any relevant proceeding;
(e) “Child at risk” means a child who: -
(i). is an orphan or is a victim of neglect by his parents or lawful guardian; or whose parents or guardians are unfit or incapacitated to look after his needs and exercise control over him; or
(ii). is without a home or settled place of abode and without any ostensible means of subsistence; or
(iii). is accused of or convicted of an offence and living at a place of detention; be it a reformatory school, borstal institution, jail or any other place notified to detain children accused of or convicted of an offence; or
(iv). is living with his mother at a place of detention; be it a special women jail or district or central jail or any other place notified to detain women accused of or convicted of an offence; or
(v). is being or likely to be abused or exploited for immoral or illegal purpose or unconscionable gain; or
(vi). lives in a brothel or frequently visits any place being used for sex or is associated with any person who leads an immoral or depraved life; or
(vii). is forced into the worst forms of the child labour, exploitative labour, or beggary; or
(viii). has suffered harm, is suffering harm, or is at unacceptable risk of suffering harm; or
(ix). is victim of any armed conflict, civil commotion or natural calamity; or
(x). is subjected to human trafficking within and outside Pakistan; or
(xi). is being misused for drug trafficking or peddling or is subjected to abuse of any intoxicating, hallucinating substances including glue, narcotic drugs, spirits etc.; and
(xii). is affected or infected with a serious disease, disabled and without any care.
(f) “Children’s Home,” or “Home” means a home set up for the care and protection of children at risk, be it a child protection centre, orphanage, etc.;
(g) “Commission” means the National Commission on the Rights of Children as set up under this Act;
(h) “Committee” means the United Nations Committee on the Rights of the Child in Geneva;
(i) “Convention” means the United Nations Convention on the Rights of the Child;
(j) “Director General” means the person appointed under sub-section (1) of section (8) of the Act;
(k) “Fund” means the Child Rights Fund established under section (22) of the Act;
(l) “Government” means the Federal Government;
(m) “Harm,” to a child,
(i). is any detrimental effect of a significant nature on the child’s physical, psychological or emotional wellbeing.
(ii). It is immaterial how the harm has been caused.
(iii). Harm could be caused by:
(a) physical, psychological or emotional abuse or neglect;
(b) sexual abuse or exploitation.
(n) “Licence” means a licence granted under this Act;
(o) “Licensee” means the holder of licence to operate a children’s home under this Act;
(p) “Licensed home” means a children’s home licensed under this Act;
(q) “Member” means a member of the Commission;
(r) “Prescribed” means prescribed by the Rules and Regulations made under this Act.
3. Principle of Administration. – (1) The Federal Government, and the Provincial Governments, shall respect and ensure the rights of children as set out in the Constitution of the Islamic Republic Pakistan and in the schedule to this Act within their respective jurisdiction.
(2) The Federal Government may amend the schedule by a notification in the Official Gazette.
4. An Act to override all other laws. - The provisions of this Act shall override the provisions of any other law for the time being in force.

تعارف
1. مختصر عنوان، دائرہ اور نفاذ: (1) یہ ایکٹ قومی کمیشن برائے حقوق اطفال ایکٹ 2009 کہلائے گا۔
(2) یہ پورے پاکستان پر لاگو ہو گا۔
(3)یہ فی الفور نافذ العمل ہو گا۔
2. تعریفیں: اس ایکٹ میں، جب تک کہ موضوع یا سیاق و سباق سے مختلف نہ ہوں، مندرجہ ذیل الفاظ اور جملے مندرجہ ذیل معنی دیں گے:
a) "بالغ" سے مراد ہر وہ شخص ہے جس نے اپنی زندگی کے اٹھارہ سال مکمل کر لئے ہوں؛
b) "کمیشن" سے مراد قومی کمیشن برائے حقوق اطفال ہے جس کا قیام ایکٹ کے سیکشن (5) کے تحت عمل میں لایا گیا؛
c) "بچے کا بہترین مفاد" ایکٹ میں جہاں کہیں "بچے کے بہترین مفاد" کا ذکر کیا جائے وہیں مفاد کے تعین کے لیے مندرجہ عناصر سامنے رکھے جائیں گے؛
I. بچے کا بدسلوکی، نظرانداز کیے جانے اور نقصان یا نقصان کے خطرے سے محفوظ رہنے کا حق؛
II. بچے کی بہبود، فلاح اور تحفظ؛
III. بچے کی جسمانی و جذباتی ضروریات اور نشوونما کی سطح؛
IV. بچے کے گھروالوں کو اس کی نشوونما کے لیے اولین ماحول سمجھا جائے اور اس کے تحفظ کی اولین ذمہ داری والدین پر سمجھی جائے؛
V. والدین یا ان کے علاوہ کسی بھی شخص سے بچے کے رشتے کا معیار اور یہ رشتہ قائم رکھنے کے اثرات؛
VI. بچے کے مذہبی، ثقافتی اور روحانی خیالات؛
VII. بچے کی تعلیم کی سطح اور اس کی ضروریات؛
VIII. بچے کو اپنے خیالات کے آزادانہ اظہار کا موقعہ دیا جانا چاہیے اور ان خیالات کو مناسب اہمیت؛ اور
IX. کوئی فیصلے کرنے میں تاخیر کے بچے پر اثرات۔
a) "بچہ/بچے" سے مراد وہ فرد جو کسی بھی موقعہ پر اٹھارہ سال عمر کی حد کو نہ پہنچا ہو؛
b) "بچہ خطرے میں" سے مراد وہ بچہ جو:
a. یتیم ہو یا اپنے والدین یا اپنے قانونی سرپرست کی لاپرواہی کا نشانہ ہو؛ یا اس کے والدین یا سرپرست اس کی ضروریات پوری کرنے یا اس پر اختیار ظاہر کرنے کی صلاحیت نہ رکھیں؛ یا
b. جو گھر یا رہائش کے مستقل مقام سے محروم ہو اور زندہ رہنے کے لیے بظاہر کوئی ذریعہ نہ رکھتا ہو؛
c. جس پر کسی جرم کا الزام یا اس کی سزا دی گئی ہو اور وہ کسی قید میں رہ رہا ہو؛ چاہے وہ اصلاحی سکول، جیل کا تعلیمی ادارہ، جیل یا کسی بھی ایسی جگہ ہو جہاں ملزم یا سزایافتہ بچوں کو رکھا جاتا ہے؛ یا
d. جسے غیر اخلاقی یا غیر قانونی مقصد کے لیے استعمال کیا جا رہا ہو یا اس کا خطرہ ہو؛ یا
e. کسی جسم فروشی کے اڈے پر رہتا ہو یا اکثر ایسی جگہ پر اس کا آنا جانا ہو جو جنسی عمل کے لیے استعمال ہوتی ہو یا کسی ایسے شخص سے جڑا ہو یا غیر اخلاقی اور گناہ کی زندگی گزار رہا ہو؛ یا
f. بچوں سے مشقت، استحصالی مزدوری یا بھیک مانگنے پر مجبور کیا جا رہا ہو؛ یا
g. جسے نقصان سے دوچار ہوا ہو، اسے نقصان پہنچ رہا ہو یا ناقابل قبول خطرے کی زد میں ہو؛ یا
h. کسی مسلح تصادم، خانہ جنگی یا قدرتی آفت کا نشانہ بنا ہو؛ یا
i. پاکستان کے اندر اور باہر انسانی سمگلنگ کا نشانہ بنا ہو؛ یا
j. منشیات کی سمگلنگ خرید و فروخت کے لیے استعمال کیا جائے یا گلو، منشیات، سپرٹ وغیرہ جیسی نشہ آور مواد استعمال کرتا رہا ہو؛ اور
k. کسی سنگین بیماری سے متاثر ہو، معذور ہو یا جس کا خیال نہ رکھا جا رہا ہو۔
(a) "مرکز اطفال" یا "مرکز" سے مراد خطرے میں گھرے بچوں کی دیکھ بھال کے لیے قائم کیا گیا گھر ہے، چاہے یہ چائلڈ پروٹیکشن سنٹر ہو یا یتیم خانہ وغیرہ؛
(b) "کمیشن" سے مراد نیشنل کمیشن برائے حقوق اطفال ہے جیسا کہ اس ایکٹ کے تحت قائم کیا گیا؛
(c) "کمیٹی" سے مراد اقوام متحدہ کی کمیٹی برائے حقوق اطفال ہے؛
(d) "کنونشن" سے مراد اقوام متحدہ کنونشن برائے حقوق اطفال ہے؛
(e) "ڈائریکٹر جنرل" سے مراد ایکٹ کے سیکشن (8) کی ذیلی شق (1 کے تحت مقرر کیا گیا افسر ہے؛)
(f) "فنڈ" سے مراد ایکٹ کی شق (22 کے تحت قائم کیا گیا حقوق اطفال فنڈ ہے؛)
(g) "حکومت" سے مراد وفاقی حکومت ہے؛
(h) "نقصان" سے مراد
(i). بچے کی جسمانی، نفسیاتی اور جذباتی بہبود پر مضر اثرات ہیں۔
(ii). چاہے یہ نقصان کسی بھی وجہ سے ہوا ہو۔
(iii). نقصان کی وجوہات یہ ہو سکتی ہیں:
(a) جسمانی، نفسیاتی یا جذباتی بدسلوکی یا لاپرواہی؛
(b) جنسی بد سلوکی یا استحصال۔
(i) "لائسنس" سے مراد اس ایکٹ کے تحت جاری کیا جانے والا لائسنس ہے؛
(j) "لائسنس یافتہ" سے مراد اس ایکٹ کے تحت مرکز اطفال چلانے کا لائسنس رکھنے والا ہے؛
(k) "لائسنس یافتہ گھر" سے مراد اس ایکٹ کے تحت قائم کردہ مرکز اطفال ہے؛
(l) "رکن" سے مراد کمیشن کا رکن ہے؛
(m) "طے کردہ" سے مراد اس ایکٹ کے تحت طے کیے گئے قواعد و ضوابط ہیں۔
3. نفاذ کے اصول ۔ (1) وفاقی حکومت اور صوبائی حکومتیں اپنی حدود میں آئین اسلامی جمہوریہ پاکستان اور اس ایکٹ کے شیڈول میں درج بچوں کے حقوق کا احترام اور ان پر عمل درآمد یقینی بنائیں گی۔
(2) وفاقی حکومت سرکاری گزٹ میں ایک نوٹیفیکیشن کے ذریعے ہی شیڈول میں ترمیم کر سکتی ہے۔
4. دیگر تمام قوانین کی جگہ لینے والا ایکٹ ۔ اس ایکٹ کے شقیں فی الوقت دیگر تمام نافذ قوانین کی جگہ لے لیں گی۔

The loss of life and property and the challenges that were faced in the aftermath of October 2005
earthquake affecting Azad Jammu and Kashmir and the NWFP province exhibited the need for
establishing appropriate policy and institutional arrangements to reduce losses from disasters in
future. The earthquake tested the resilience and capacity of Pakistan and its people to overcome
catastrophes.
The need for strong institutional and policy arrangements has been fulfilled with the promulgation
of the National Disaster Management Commission (NDMC), the National Disaster Management
Authority (NDMA), and the passing of the National Disaster Management Ordinance, 2006.
This Framework prepared with active participation of multiple stakeholders serves as a vision
document for leading the way towards a safer Pakistan. The Framework provides guidelines to
coordinate activities of numerous stakeholders. It also sets out priorities for mobilization of
resources from donors and development partners of Pakistan to implement strategic activities
during the next five years. The journey towards a safer Pakistan requires cooperation of all
concerned ministries, departments, technical agencies, armed forces, provincial governments,
UN agencies, media, NGOs, donors and most of all the vulnerable communities.
The Framework has been formulated through a consultative process involving stakeholders,
ranging from government ministries and departments, technical agencies, UN agencies, NGOs
and donors. This helped in identification of gaps, needs, priorities and strategies for further
action.
The immediate priorities will be addressed by NDMA in a systematic manner in collaboration with
relevant stakeholders. Considering the fact that disaster risk management is a provincial subject,
the cooperation and political will of the provincial governments through the Provincial Disaster
Management Authorities (PDMAs) would be critical for successful implementation of priorities
identified in the Framework.
Extensive feedback was received from stakeholders during the consultation process. NDMA has
tried to integrate the essence of comments of all stakeholders to the extent possible, while
finalizing the Framework. We were not able to incorporate certain valuable comments, which
were out of the scope of a National Framework. I take this opportunity to sincerely thank all the
stakeholder agencies and individuals who contributed to the conception and compilation of this
important document. I also deeply appreciate the valuable services rendered by the United
Nations Development Programme (UNDP) in formulation of the Framework.
I am confident that the implementation of Framework will lead to a Pakistan safer from disasters.

اکتوبر2005 میں آزاد کشمیر اور صوبہ سرحد میں زلزلے سے ہونے والے جانی و مالی نقصان نے مستقبل میں قدرتی آفات سے نقصان کے خطرے کو کم کرنے کی حکمت عملی اپنانے کی ضرورت اجاگر کی۔ زلزلے نے مصیبت کی صورت میں پاکستانی عوام کی ہمت اور صلاحیت آزمائی۔
