Secondo statistiche dell‘Alto Commissariato per i rifugiati delle Nazioni Unite (ACNUR), recentemente sono state presentate in Europa da 27 a 33 mila domande d’asilo. A queste cifre si aggiungono quelle sui clandestini, fornite dall’OIM, secondo cui da 300 a 500 mila persone entrano illegalmente nel vecchio continente ogni anno.
L’ACNUR ha sostenuto ripetutamente l’importanza di una strategia europea sull’asilo, che garantisca un’elevata protezione per i rifugiati e i richiedenti asilo, nel rispetto della Convenzione di Ginevra del 1951 e di quella europea del 1950, sui diritti umani e le libertà fondamentali. La complessa questione dei flussi migratori, forzati e non, è oggi divenuta urgente anche per l’Unione europea, che già con il Trattato di Amsterdam del 1997 ha costituito le basi legali per l’azione comunitaria.
Da parte sua, il Parlamento europeo è intervenuto, contribuendo, con l’adozione del rapporto Schmitt (PPE/DE, D) a porre le premesse per una definizione chiara ed equa della politica europea di asilo.
Nel documento approvato, l’Assemblea ha infatti precisato che obiettivo comune dei quindici Paesi membri è di garantire a ciascun richiedente asilo il conseguimento di un’identica decisione, indipendentemente dallo Stato in cui abbia presentato l’istanza.
L’Esecutivo europeo è invitato a ridurre gli strumenti giuridici proposti, tenendo conto della direttiva sulla protezione temporanea degli sfollati, degli esuli per guerre civili e di altre categorie beneficiarie. Al riguardo, l’Aula rileva la necessità di una netta distinzione tra rifugiati, che rientrano nella definizione della Convenzione di Ginevra, immigrati economici e profughi provenienti da aree in crisi.
Translation - English Europe: Refuge or Stronghold for Asylum Seekers?
According to statistics from the United Nations High Commission for Refugees (UNHCR), in recent times Europe has received 27 to 33 thousand applications for asylum. Added to this figure is the number of clandestine entries, prepared by the IOM, which estimates that between 300 and 500 thousand people enter the Old Continent illegally each year.
The UNHCR has repeatedly stressed the importance of a European strategy for asylum that guarantees elevated protection for refugees and asylum seekers with respect to the Geneva Convention of 1951 and the European equivalent in 1950 on human rights and fundamental liberties. The complex question of migration waves, whether forced or not, has become urgent today even for the European Union which, in accordance with the Amsterdam Treaty of 1997, has already established a legal model for community action.
The European Parliament, with its adoption of the Schmitt Report (PPE/DE, D) has intervened and contributed on its own part by laying down a preamble for a clear and equitable definition of asylum for European policy.
In the approved document, the Assembly has actually stated that the common objective of the fifteen member states is to guarantee every asylum seeker an identical decision, regardless of the country in which the application is made.
The European Executive is asked to reduce the proposed legal procedures, taking into account the directive on temporary protection of evacuees, persons in exile from civil wars and those in other beneficiary categories. With regard to this, the court recognises the necessity for a net distinction between refugees, to distinguish between those that fall into the Geneva Convention’s definitions of economic immigrants and refugees from crisis areas.
