(a) The question for the court
On 1 January 1973, the United Kingdom joined the European Communities. This occurred as a result of a process of Treaty negotiation by the government, the enactment of the European Communities Act 1972 ("the ECA 1972") to give effect to Community law in the national legal systems of the United Kingdom and then ratification by the United Kingdom and other Member States of the amended Community Treaties. Thus, as a result of the ECA 1972, Parliament by primary legislation gave effect in each jurisdiction of the United Kingdom to binding obligations and rights arising under those Treaties. In due course the European Communities became the European Union.
On 23 June 2016, a referendum took place under the European Union Referendum Act 2015 ("the 2015 Referendum Act"). The question asked in the referendum was "Should the United Kingdom remain a member of the European Union or leave the European Union?" The answer given in the referendum was that the United Kingdom should leave the European Union.
Withdrawal from the European Union under the Treaty provisions of European Union is governed by Article 50 of the Treaty on European Union ("TEU"). That Article came into force in 2009 after amendment of the TEU by the Lisbon Treaty of 2007.
The sole question in this case is whether, as a matter of the constitutional law of the United Kingdom, the Crown — acting through the executive government of the day - is entitled to use its prerogative powers to give notice under Article 50 for the United Kingdom to cease to be a member of the European Union. It is common ground that withdrawal from the European Union will have profound consequences in terms of changing domestic law in each of the jurisdictions of the United Kingdom.

Son retrait aura, sans conteste, des conséquences profondes en termes de modification du droit national dans chacune des juridictions du Royaume-Uni.

استطاعت ظاهرة التلفزيون الفضائي في السنوات الأخيرة أن تنتشر بوتيرة سريعة بفعل الأجهزة الالكترونية والأقمار الاصطناعية التي تبث على مدار الساعة. وأصبح إقبال الجمهور على برامج الفضائيات قوياً، كما شكّل تأثير هذه البرامج في سلوكيات الفرد والعائلة، والمجتمع عموماً، منعطفاً في الاتجاهات والقيم، ولا سيما اتجاهات الشباب الاجتماعية والثقافية والسياسية.
ومن أهم مؤشرات هذا التغيير، غياب الشباب عن النشاطات الثقافية المنظمة، وميلهم نحو ممارسات أخرى، منها استعارة الأشرطة السمعية – البصرية، والأقراص الممغنطة، واستعمال الإنترنت.
وتبيّن أيضاً أن الفضائيات تضع الأسرة أمام تحديات جديدة، أقلّها أن معظم البرامج التي تقترحها لا تستجيب لمقتضيات النَسَق القَيِمي الذي تحتكم إليه الأُسَر، وهذا الأمر قد أدى إلى تشتت وحدة المشاهدة الأُسَرية، وظهور النمط الانفرادي، وتلاشي أنماط التواصل الاجتماعي المباشر داخل الفضاء الأُسَري، وبالتالي إحساس الشباب بالغربة عن الجو العائلي، إضافة إلى فتور الروابط التي تجمعهم بباقي أفراد الأسرة.
لكن الفضائيات تلعب دورا استراتيجيا في التنشئة الاجتماعية والمواطنة والولاء لنظام ولقيم مجتمعية محددة، وهي وسيلة مهمة لمحاورة الآخر وتسويق صورة الأمة وقيمها وحضارتها للعالم. فإذا كان تحقيق ملايين الدولارات على حساب هذه الأهداف النبيلة هو المقياس وهو معيار النجاح، فهذا يعني أن المؤسسة الإعلامية أصبحت مثل مصنع الإسمنت لا علاقة لها بالفكر وبالقيم وبالحضارة وبالثقافة وبالذاكرة الاجتماعية وبإنسانية الإنسان وأدميته وبالهوية الثقافية.
Translation - French Au cours de ces dernières années, le phénomène de la télévision par satellite s’est propagé à un rythme effréné grâce au [développement] des technologies électroniques et des satellites, qui diffusent en continu. Les programmes des télévisions par satellite connaissent un vif succès auprès du public, et l’impact de ces derniers sur le comportement individuel, familial, et même sociétal représente un véritable bouleversement dans les orientations et les valeurs sociales, culturelles et politiques, en particulier chez les jeunes.
L’absence de la jeunesse dans les activités culturelles structurées illustre parfaitement ce changement. Leurs intérêts se portent sur d’autres activités comme l’échange de cassettes audio et vidéo et de disques compacts ainsi que l’utilisation d’internet.
Par ailleurs, les télévisions par satellite mettent la famille face à de nouveaux défis. En effet, la plupart des programmes proposés ne répondent pas aux exigences du système de valeurs sur lequel repose la famille, ce qui est à l’origine de l’éclatement de l’unité familiale car désormais [dans les foyers arabes], la télévision se regarde séparément. Ce phénomène a entrainé la disparition des modes de communication directe à l’intérieur de l’espace familial. Par conséquent, [la télévision par satellite accentue] le sentiment d’exclusion des jeunes de l’espace familial et [contribue] à l’affaiblissement des liens qui soudent les membres d’une famille.
Cependant, les télévisions par satellite jouent un rôle stratégique dans l’éducation de la société, dans la citoyenneté et dans l’allégeance à un système social et à des valeurs sociales déterminées. C’est un moyen important pour dialoguer avec l’Autre et promouvoir l’image, les valeurs et la civilisation de la nation [arabe] auprès du reste du monde. Si le critère de la réussite est de réaliser des millions de dollars [de bénéfices] au détriment de ces objectifs nobles, alors l’institution médiatique s’apparente à une usine quelconque sans rapport avec la pensée, les valeurs, la civilisation, la culture, la mémoire collective, l’humanité de l’homme et l’identité culturelle.
