Responsible disposal of your old and damaged ICT equipment
This brochure on Electronic Waste (e-waste) has been developed as part of the Consumer Education Programme of the Communications Authority of Kenya and presents the current perception of the information available on e-waste in Kenya.
Definition of e-waste
Electronic waste, e-waste or Waste Electrical and Electronic Equipment (WEEE) refer to old, discarded electrical or electronic devices.
Categories of e-waste
There are various categories of e-waste as follows:
• Large and small household appliances
• IT and telecommunication equipment
• Consumer equipment
• Lighting equipment
• Electrical and electronic tools
• Toys leisure and sports equipment
• Medical equipment
• Monitoring and control instruments
• Automatic dispensers
The E-waste status in Kenya
Electronic waste is one of the fastest growing segments of our nation's waste stream especially from the disposal of telecommunication equipment such as mobile phones, and computer parts.
This rise is due to the exponential increase in the quest to access to communication services to all in order to bridge the digital divide. Various global and Kenyan Government initiatives have contributed to the current tremendous growth of the communications sector by facilitating communication, trade and sale of affordable communication devices.
Refurbished electronics are also the leading contributors to e-waste in Kenya. The other factor is the ever-increasing demands by consumers who always seek the latest and most fashionable communication devices, which would thus result to the disposal of the old devices.
Consumers dispose of their communication devices in various ways such as selling to friends and other family members, storing, burning or trashing. Some consumers retain the devices in their homes for sentimental value or for lack of an appropriate method of disposal. These forms of disposal are not recommended.
Inappropriate disposal of e-waste is dangerous as it impacts negatively on the environment and poses danger to human health.
What makes e-waste dangerous
E-waste dangers stem from elements used to manufacture the devices lead, mercury, arsenic, cadmium, copper, beryllium, barium, and chromium, and nickel, zinc, silver and gold.
When e-waste is disposed off in landfills or garbage dumps, the toxic chemicals of the e-waste can seep into the ground (possibly entering the water supply) or escape into the atmosphere, affecting the health of nearby communities.
Some of the serious negative effects from acute and continuous exposure to high levels of these elements in e-waste are the following:
a. Health Effects:
• Damage to central and peripheral nervous systems, blood systems and to the kidneys.
• Affects child brain development.
• Irreversible toxic effects on human health.
• Chronic brain damage.
• Respiratory and skin disorders
• Reproductive and developmental problems
• Damage to the immune system
• Interference with regulatory hormones
• Disrupts functions of the endocrine system.
b. Environmental Effects:
• E-waste causes air, water and soil pollution
c. Social Effects
• On the negative, e-waste raises the cost in health care.
• On the positive, it increases informal trade and management of e-waste
If appropriately disposed, e-waste can be a source of raw materials for various sectors of the economy.
How to mitigate the adverse effects of e-waste
There are two key international conventions regulating waste management, namely the Basel and Bamako Conventions. Kenya has ratified the Basel Convention.
The Conventions require signatories to ensure that:
• The generation of hazardous waste within a country is reduced to a minimum, taking into account social, technological and economic factors.
• Steps are taken to minimize pollution and its health consequences as far as possible especially where a country exporting the hazardous waste does not have the technical capacity, necessary facilities, or suitable disposal sites to dispose of the waste in an environmentally sound and efficient manner.
However, Kenya does not have an e-waste management policy that specifically deals with the disposal/re-use of e-waste. In the absence of such policy, NEMA developed the Legal Notice No 121 on Environment and Coordination (Waste Management) Regulation 2006. The regulation defines e-waste as hazardous waste - including those with heavy metal content - which require special treatment and disposal after approval by the Authority.
This lack of disposal methods meant that the preferred action was to export the waste, yet a large amount would end up in dumpsites.
NEMA has also developed the Guidelines for E-waste Management in Kenya that forms the basis of development of e-waste regulations and policy in the country.
The guidelines provide information on how to streamline the procedures of handling and disposal of e-waste generated by various sectors and a framework for identification, collection, sorting, recycling and disposing of electrical and electronic waste. They also provide a basis for developing legal instruments to enhance enforcement of the procedures.
CA’s efforts in addressing e-waste management issues
The Communications Authority of Kenya (CA), in its role as a converged regulator under the new legal framework as provided under the Kenya Communication (Amendment) Act, 2013, recognizes that e-waste is at the very crux of the relationship between ICT and environmental sustainability. In an effort to address e-waste and promote growth in the communication industry by increasing penetration of communication services, the Authority implemented the following initiatives:
• Inclusion of e-waste management requirement in licensing conditions
The Kenya ICT Policy 2019 recognizes the dangers of e-waste and states provides for the development of comprehensive policies on electric and electronic waste management, based on a positive relationship with stakeholders and the development of mechanisms of coordination between the public, private and decentralized sectors and civil society.
It also provides for the development of an inventory of e-waste production, collection and recycling in the country and work to identify and eliminate the main bottlenecks in the recycling chain.
The Government will also provide incentives for the adoption of best practices to encourage reduction of carbon footprint, efficient energy management, e-waste recycling, water tower restoration, afforestation and recycling of ICT products.
Additionally, the Government will provide incentives for investors and innovators who develop ICT waste disposal and recycling facilities that meet agreed global safety and environment standards.
The implementation of such policies will ensure that the operators become more responsible in handling e-waste by ensuring the safe use of electronic equipment and putting in place measures for achieving minimum environmental effect by e-waste. Consequently, the new unified licensing framework implemented in 2008 requires licensees to “ensure that the licensed systems/equipment do not become a health, environmental or a safety hazard…”
• Type Approval of Communication Equipment
Type approval of mobile handsets ensures that communication equipment is not and will not become a health hazard and conform to the standards set by the Kenya Bureau of Standards (KEBS).
• Deployment and decommissioning of communication infrastructure
Communication service providers are encouraged to share communication facilities and adhere to the requirement of Environmental Management and Coordination Act (EMCA), 1999, which calls for identification and implementation of mitigation measures in the deployment and decommissioning of communication infrastructure.
• Memorandum of Understanding between CA and NEMA
The MOU requires the Authority and NEMA to cooperate in the development of policies, guidelines and other instruments required for the proper disposal of electronic waste in Kenya.
• Stakeholder consultation on e-waste management
The Authority, with a view to catalyse the progress in the development of e-waste management framework in Kenya, continues to engage stakeholders including NEMA on initiatives that can enhance the safe disposal of e-waste in the country.
• Madaraka Initiative
The objective of the Madaraka Initiative is to assemble local computer units with the aim of providing quality and affordable PCs to the market. The project came in the wake of rising fears that Kenya had become a dumping site for electronic waste in the form of outdated PCs and other computer hardware and software.
The Authority provided KShs. 10 million to two technology institutions to fund the establishment of a proposed local assembly point for computers under the Madaraka Initiative.
How to responsibly purchase, use, re-use and dispose of ICT equipment
Organizations and consumers wishing to responsibly purchase, use, re-use and dispose of ICT should;
a) Donate the equipment to other users or organizations. This would extend the life of valuable products and keep them out of the waste management system for a longer period e.g. to schools and NGO’s. The equipment donated should be in good working condition.
b) Separate all electronic and electrical waste from all other garbage and household waste as you dispose of the waste. E-waste should never be disposed of with garbage and other household waste.
c) Dispose e-waste through designated organizations licensed to dispose of hazardous waste.
d) While buying electronic products opt for those that:
• are made with fewer toxic constituents
• use recycled content
• are energy efficient
• are designed for easy upgrading or disassembly
• utilize minimal packaging
• offer leasing or take back options
• Have been certified by regulatory authorities
• Opt for upgrading their computers or other electronic items to the latest versions rather than buying new equipments.
Where and how to dispose of e-waste in Kenya
The following are ways in which you could appropriately dispose of your communication devices:
1. Manufacturers of ICT Devices: Some communication device manufactures have developed an extensive program to take back old and obsolete communication devices. Seek information from device manufacturers to find out if they have a “Take Back Program” to enable them appropriately dispose of the equipment.
2. Drop off at licensed waste recycling companies that dismantle and manage e-waste. These include the following:

Ufafanuzi wa takataka za kielektroniki
Takataka za kielektroniki ama Takataka za Vifaa vya Umeme na Kielektroniki (WEEE) zinamaanisha vifaa vya umeme au vya kielektroniki vilivyotupwa.

Hali ya Takataka za Kielektroniki nchini Kenya
Takataka za Kielektroniki ni mojawapo ya kitengo cha mkondo wa takataka humu nchini kinachokuwa kwa haraka zaidi hususan kutoka kwa utupaji wa takataka za vifaa vya mawasiliano ya simu kama vile simu za rununu na vipuri vya kompyuta.
Ongezeko hilo linatokana na kuongezeka kwa mahitaji ya kufikia huduma za mawasiliano kwa kila mtu ili kusawazisha utofauti uliopo wa mfumo wa kidijitali. Miradi mbali mbali ya kimataifa pamoja na ile ya Serikali ya Kenya imechangiua pakubwa ukuaji wa haraka wa sekta ya mawasiliano kwa kuwezesha mawasiliano, biashara na uuzaji wa vifaa vya mawasiliano kwa bei nafuu.
Kadhalika, vifaa vya umeme vilivyorekebishwa zimechangia pakubwa kuongezeka kwa takataka za kielektroniki nchini Kenya. Sababu nyingine ni ongezeko la kila siku la mahitaji ya watumiaji huku wakiagiza vifaa vya fasheni na vya mawasiliano ya kisasa zaidi, hatua ambayo hatimaye husababisha kutupwa kwa vifaa vya kitambo zaidi.
Watumiaji hutupa vifaa vyao vya mawasiliano kwa njia mbali mbali kama vile kuwauzia marafiki pamoja na wanafamilia wengine, kuhifadhi, kuchoma na kutupa kama takataka. Baadhi ya watumiaji huwacha vifaa hivyo kwa nyumba zao kwa kuwa wanavithamini au kwa kukosa njia inayofaa ya kuvitupa vifaa hivyo. Njia hizi za kutuapa takataka hazipendekezwi.
Utupaji wa takataka za kielektroniki ovyo ovyo ni hatari kwani huwa unaathiri vibaya mazingira na husababisha madhara makubwa kwa afya ya mwanadamu.
Kile kinachofanya takataka za kielektroni kuwa hatari sana
Hatari ya Takataka za Kielektroniki huanzia kwenye vipengee vinavyotumika kuunda vifaa hivyo kama vile risasi, zebaki, arseniki, kadimi, shaba, beriliamu, bariamu, na kromiamu, and nikeli, zinki, fedha na dhahabu.
Wakati takataka za kielektroniki zinapotupwa katika maeneo au mabiwi ya taka, kemikali za sumu za takataka hizo za kielektroniki huingia ardhini (na hata huweza kuingia kwenye mfumo wa usambazaji wa maji) au kuingia hewani, huku ikiathiri pakubwa jamii inayoishi karibu na eneo hilo.
Baadhi ya athari mbaya zaidi na kuendelea kujihatarisha kwa viwango vya juu vya vipengee hivi kwenye takataka za kielektroniki ni kama zifuatazo:
a. Athari za Kiafya:
• Uharibifu wa mifumo ya neva ya sehemu za katikati na pembeni, mifumo ya damu na hadi kwenye figo.
• Inaathiri ukuaji wa ubongo wa mtoto
• Athari za sumu mbaya sana kwa afya ya mwanadamu.
• Uharibifu sugu wa ubongo.
• Matatizo ya kupumua na ngozi
• Matatizo ya uzazi na ukuaji
• Uharibifu wa mfumo wa kinga mwilini
• Muingiliano wa homoni zinazothibiti mwilini
• Kuvuruga utendakazi wa mfumo unaounda homoni.
b. Athari za Kimazingira:
• Takataka za Kielektroniki husababisha uchafuzi wa hewa, maji na mchanga
c. Athari za Kijamii
• Katika mtazamo hasi, takataka za kielektroniki huongeza gharama katika huduma ya afya.
• Katika mtazamo chanya, huongeza biashara isiyo rasmi pamoja na usimamizi wa takataka za kielektroniki
Takataka za kielektroniki zinapotupwa kwa njia inayofaa huweza kuwa malighafi ya sekta mbali mbali za uchumi.
Jinsi ya kupunguza athari mbaya za takataka za kielektroniki
Kuna mikataba miwili mikuu ya kimataifa inayodhibiti usimamizi wa takataka, hii ni pamoja na Mikataba ya Basel na Bamako. Kenya imejiunga na Mkataba wa Basel.
Mikataba hiyo inahitaji wanayotia saini kuhakikisha kwamba:
• Kizazi cha takataka zenye sumu humu nchini kimepungua kiasi, kwa kuzingatia sababu za kijamii, kiteknolojia pamoja na kiuchumi.
• Hatua zinachukuliwa ili kupunguza uchafuzi wa mazingira na athari zake za kiafya kadri iwezekananvyo hususan pale ambapo nchi inayotoa takataka za sumu haina uwezo wa kiufundi, vituo muhimu, ama maeneo yanayofaa kutupa takataka kwa namna inayofaa na itakayolinda mazingira.
Hata hivyo, Kenya haina sera ya usimamizi wa takataka za kielektroniki hususan ile inayoshughulikia utupaji/utumiaji upya wa takataka za kielektroniki. Kwa kutokuwepo kwa sera kama hiyo, NEMA iliunda Ilani ya Kisheria Nambari 121 kuhusu Masharti ya Mazingira na Uratibu (Usimamizi wa Takataka) 2006. Masharti hayo yanaelezea takataka za kielektroniki kama takataka zenye sumu - ikiwa ni pamoja na zile zenye chuma nyingi ndani - zinazohitaji ushughulikiwaji maalum na kutupwa baada ya kuidhinishwa na Mamlaka.
Ukosefu huu wa njia muafaka za kutupa takataka ulimaanisha kwamba hatua iliyopendelewa zaidi ilikuwa ni kuzipeleka takataka mbali, huku kiwango kikubwa cha takataka hizo kikiishia kutupwa kwenye sehemu za majalala ya takataka.
Kadhalika, NEMA imeunda Mwongozo wa Usimamizi wa Takataka nchini Kenya, ambao hatimaye unaandaa msingi thabiti wa kuundwa kwa masharti pamoja na sera ya takataka za kielektroniki humu nchini.
Miongozo hiyo inatoa taarifa kuhusu jinsi ya kuendesha utaratibu wa kushughulikia pamojanna kutupa takataka za kielektroniki zilizozalishwa na sekta mbali mbali pamoja na mfumo wa utambulisho, ukusanyaji, uteuzi, ujalalishaji na utupaji wa takataka za umeme na za kielektroniki. Kadhalika, wanatoa msingi wa uandalizi wa vyombo vya kisheria ili kuimarisha ushughulikiwaji wa taratibu hizo.
Jitihada za CA katika kushughulikia masuala ya usimamizi wa takataka za kielektroniki
Katika jukumu lake kama msimamizi mkuu chini ya mfumo mpya wa kisheria kama ulivyo chini ya Sheria ya Mawasiliano ya Kenya (Marekebisho), 2013, Mamlaka ya Mawasiliano ya Kenya (CA) inatambua kwamba takataka za kielektroniki zina uhusiano wa moja kwa moja kati ya uendelevu wa TEHAMA na mazingira. Katika jitihada za kushughulikia masuala ya takataka za kielektroniki pamoja na kutangaza ukuaji kwenye sekta ya mawasiliano kwa kuimarisha ufikiwaji wa huduma za mawasiliano, Mamlaka hii ilitekeleza mipango ifuatayo:
• Ushirikishaji wa mahitaji ya usimamizi wa takataka za kielektroniki katika masharti ya kutoa leseni
Sera ya TEHAMA ya Kenya 2019 inatambua hatari za takataka za kielektroniki na taifa linatoa njia za uundwaji wa sera kamilifu kuhusu usimamizi wa takataka za vifaa vya umeme na vile vya kielektroniki, kulingana na ushirikiano chanya na washikadau pamoja na uandaaji wa mifumo ya uratibu kati ya sekta ya umma, binafsi na zile zilizogatuliwa pamoja na mashirika ya kiraia.
Kadhalika, inatoa fursa ya uundwaji wa orodha ya uzalishaji wa takataka za kielektroniki, ukusanyaji na ujalalishaji humu nchini na kushughulika ili kutambua na kuondoa pingamizi kuu katika utaratibu mzima wa ujalalishaji.
Kadhalika Serikali itatoa takrima kwa utumiaji mzuri wa taratibu zinazofaa ili kuhimiza kupunguza uwepo wa alama za kaboni, usimamizi bora wa kawi, ujalalishaji wa takataka za kielektroniki, uhifadhi wa vyanzo vya maji, upandaji wa miti na ujalalishaji wa bidhaa za TEHAMA.
Zaidi ya hapo, Serikali itatoa takrima kwa wawekezaji na wabunifu wanaounda vituo vya uundaji wa mbinu za utupaji wa takataka za TEHAMA pamoja na ujalalishaji utakaozingatia viwango vinavyokubalika vya ubora wa kimataifa vya usalama pamoja na mazingira.
Utekelezwaji wa sera kama hizo utahakikisha kwamba waendeshaji wanawajibika zaidi katika ushughulikiaji wa takataka za kielektroniki kwa kuhakikisha utumiaji salama wa vifaa vya kielektroniki na kuweka taratibu muafaka za kupunguza athari za kimazingira za takataka za kielektroniki. Kwa sababu hiyo, huo mfumo mpya wa leseni uliotekelezwa 2008 unawahitaji wenye leseni “kuhakikisha kwamba mifumo/vifaa vilivyotolewa leseni havileti hatari ya kiafya, kimazingira ama kiusalama…”
• Aina ya Uidhinishaji wa Kifaa cha Mawasiliano
Aina ya uidhinishaji wa simu za rununu inahakikisha kwamba kifaa cha mawasiliano sio na hakitakuwa na hatari ya kiafya na pia kinazingatia viwango vya ubora vilivyowekwa na Taasisi ya Viwango vya Ubora ya Kenya (KEBS).
• Upelekaji na uondoaji wa muundomsingi wa mawasiliano
Watoaji wa huduma za mawasiliano wanahimizwa kutumia kwa pamoja vituo vya mawasiliano na kufuata mahitaji ya Sheria ya Usimamizi na Uratibu wa Mazingira (EMCA), 1999, inayoagiza utambulisho na utekelezaji wa hatua za kupunguza katika upelekaji na uondoaji wa muundomsingi wa mawasiliano.
• Memoranda ya Makubaliano kati ya CA na NEMA
Memoranda ya Makubaliano (MOU) inaitaka Mamlaka pamoja na NEMA kushirikiana katika uundaji wa sera, miongozo na vyombo vingine vinavyohitajika kwa ajili ya utupaji unaofaa wa takataka za kielektroniki nchini Kenya.
• Ushauri wa washikadau kuhusu usimamizi wa takataka za kielektroniki
Kwa lengo la kuchochea shughuli za maendeleo ya mfumo wa usimamizi wa takataka za kielektroniki nchini Kenya, Mamlaka hii inaendelea kuwashirikisha washikadau wakiwa ni pamoja na NEMA katika mipango itakayoimarisha utupaji salama wa takataka za kielektroniki humu nchini.
• Mpango wa Madaraka
Lengo la Mpango wa Madaraka ni kukusanya kompyuta zinazopatikana humu nchini kwa nia ya kutoa ngamizi bora na za bei nafuu kwa soko. Mradi huu ulikuja wakati ambapo kulikuwa na hofu kubwa kwamba Kenya imekuwa jalala la takataka za kielektroniki kwa njia ya kompyuta zilizopitwa na wakati na maunzi pamoja na programu nyingine.
Mamlaka ilitoa kitita cha KShs. Milioni 10 kwa asasi mbili za kiteknolojia ili kugharimia uundwaji wa kituo kilichopendekezwa cha uunganishaji wa kompyuta humu nchini chini ya usimamizi wa Mpango huu wa Madaraka.
Jinsi ya kuwajibika wakati wa kununua, kutumia, kutumia upya na kutupa kifaa cha TEHAMA
Mashirika na watumiaji wanaopenda kuwajibika wakati wa kununuam kutumiam kutumia tena pamoja na kutupa TEHAMA wanafaa;
a) Kutoa mchango wa kifaa kwa watumiaji wengine ama mashirika. Hatua hii itaongezea thamani ya maisha ya bidhaa hizo na kuviondoa katika mfumo wa usimamizi wa takataka za kielektroniki kwa kipindi kirefu k.v kwa shule na Mashirika Yasiyo ya Kiserikali. Kifaa kilichotolewa kama mchango kinafaa kuwa katika hali nzuri ya kuweza kutumika.
b) Tenganisha takataka zote za umeme na zile za kielektroniki kutoka kwa taka nyinginezo pamoja na takataka za nyumbani wakati unapotupa takataka hizo. Takataka za kielektroniki hazipaswi kabisa kutupwa pamoja na takataka pamoja na uchafu wa nyumbani.
c) Tupa takataka za kielektroniki kupitia kwa mashirika yaliyo na leseni ya kutupa takataka hatari.
d) Wakati unaponunua bidhaa za kielektroniki, chagua zile ambazo:
• zimeundwa kwa kutumia vipengee vichache mno vya sumu
• zinatumia vitu vilivyojalalishwa
• zinahifadhi kawi ya kutosha
• zimeundwa kwa njia ambayo ni rahisi kuboresha ama kutenganisha
• zitakazofunguliwa kwa urahisi
• zinatoa fursa ya ukodishaji ama chaguo la kurudisha baadae
• zimeidhinishwa na mamlaka za usimamizi
• zimechagua kuboresha kompyuta zao ama bidhaa nyingine za kielektroniki kwa kiwango cha kisasa zaidi badala ya kununua vifaa vipya.
