limitation of liability Customer's/Client's failure to perform (i.e. its obligations/responsibilities under the Contract/Agreement) is generally discussed under the heading 'Limitation of liability' (or a similar heading) rather than being used as a heading itself.

agree Kitty Brussaard : Indeed, I suggested this option already in my peer comment to Annabel's answer :-). I prefer this to 'breach of contract' because client's failure to perform the agreement may or may not be imputable failure.

Could also be failure, depending on the circumstances

agree Kitty Brussaard : If this is indeed about 'tekortkoming van de opdrachtgever in het naleven van zijn verplichtingen' then 'client's failure to perform the agreement' will fit the bill. This is not always deemed 'breach of contract', depending on the circumstances!
