My next problem is from the same passage:
De conclusie moet zijn dat de toegepaste vrijheidsontneming geen grondslag vindt in art. 55 Vw 2000. In het midden kan dan ook blijven of, indien deze conclusie anders zou moeten luiden, art. 55 wel kan worden aangemerkt als een van de in art. 5 lid 1 onder a t/m f EVRM limitatief opgesomde uitzonderingen op het verbod op vrijheidsontneming. *** Een en ander betekent*** dat de vrijheidsontneming die in de land AC’s plaatsvindt onrechtmatig is.
I translated this as
Leaving aside the issue of whether, if concluded otherwise, Article 55 could be considered to form part of the exhaustive list of exceptions specified under Article 5 Paragraph 1 (a) to (f) inclusive of the European Convention on Human Rights (ECHR) regarding the prohibition of deprivation of liberty, ***more than one indicator*** points to the fact that the deprivation of liberty enforced in the regional ACs is unlawful.
The agency did not like it and have changed it to:
There is no need to determine whether, if the legislation were prescribed by law, it could be considered to form part of the exhaustive list of exceptions specified under Article 5 Paragraph 1 (a) to (f) of the European Convention on Human Rights (ECHR) regarding the prohibition of deprivation of liberty. ***Thus*** the deprivation of liberty enforced in the regional ACs is unlawful.
I do not go along with "thus" for "een en ander betekent" but perhaps somone can put me right
