Either Party may terminate this Agreement in whole or in part upon notice to the other Party if the other Party files a petition of bankruptcy or the equivalent thereof or is the subject of an involuntary petition in bankruptcy that is not dismissed within sixty (60) days after the filing date thereof, or is or becomes insolvent, or admits to a financial impairment or a general inability to pay its debts as they become due (except, in each case, where the Party in question is still able to pay fees due under this Agreement as they become due)

Merci. Une moins-value est aussi une dégradation financière mais ici ce pourrait être la somme de plusieurs moins-values et d'autres pertes qui conduisent à une dégradation générale du bilan. Il est assez difficile de savoir.
