The sentence states: Now comes Plaintiff, ..., pleading hypothetically and in the alternative, states as follows.

The sentence is repeated in every count of the complaint.

hypothetisch und als Eventualantrag

alternative pleadings = "Eventualanträge, Unteranträge, subsidiäre Schlüsse" according to Le Docte, "Legal Dictionary in Four Languages". The hypothetical can be tarnslated straightforwardly as "hypothetisch".
