Herzlichen Dank an alle, in diesem Fall enthalten die von Rolf eingestellten Links für mich die nützlichsten Informationen. Offenbar sollen der Beklagten tatsächlich die Kosten erstattet werden.

"To have the costs" kann in diesem Kontext durchaus bedeuten, Kosten erstattet zu bekommen.

"Gewonnen" hat die Beklagte. Das Land ist Hongkong. Der vollständige Satz lautet wie folgt: "As to costs, we make an order nisi that the respondent (W) should have the costs of this appeal, such costs to be taxed if not agreed."

Wer hat denn "gewonnen", Inga? Meist kriegt ja der Unterlegene die Kosten aufgebürdet. Welches Land ist das überhaupt?

"Der Beklagte"

Respondent ist der Beklagte in einem Zivilverfahren. "Should have the costs" ist etwas ungewöhnlich; aber vielleicht liegt das daran, dass es "Hongkong-Englisch" ist. Ich verstehe es als "sollte/dürfte die Kosten zu tragen haben" oder "hat die Kosten zu tragen" -- je nachdem, um was für ein Schriftstück es sich handelt. Mit mehr Hintergrund könnte man wohl genauer formulieren.
