Each party recognizes that there is a ***Social Security retirement program*** to which contributions may have been made by a party from community property earnings during the marriage.
Each party further acknowledges that a spouse married for ten (10) or more years to a party (the “earning spouse”) who has contributed to Social Security has independent Social Security rights under the Social Security Act (“derivative benefits”), but no community property rights under present California law in the earning spouse’s Social Security benefits.
Acknowledging this state of the law, and recognizing that the law may be subject to change, each party waives and quitclaims any right to claim an interest in the Social Security benefits to be received by the other.
