English term

Breach and Default

English to Hebrew Law/Patents Law (general) terms
Are both the same with Default being the American equivalent of the British Breach or vice versa, or am I completely off here?

Example term: material breach, material default
"...except for any default by Developer under Sections..."
"...failure to meet the development schedule thereunder, any material default by Developer..."
Proposed translations (Hebrew)
5 הפרה ומחדל
5 הפרה והעדר פעולה

הפרה ומחדל

Default is failing to do something or anything, and the legal jargon has it as:
מחדל
[Moses Legal Dict.]
That's what I normally use when no specific issue is mentioned.
Note from asker:
Thank you Doron. Is it possible that Americans use default for all cases of default and breach?

הפרה והעדר פעולה

breach = הפרה
default = העדר פעולה

(Babylon on default - failure to perform a duty; failure to pay on time; failure to appear in court)
