disagree Terry Moran : I think "legally not effective" goes further than the original, which just says that they haven't yet been shown to be legally effective - it isn't concerned with whether they are or not.

counterclaims that are contested and on which no judgment has been entered

rechtskräftig festgestellt means supported by a judgment debt. Not only KudoZ entries are doubtful, but even the ECJ trans. dept. seems to have a problem with the term 'judgment debts'.
