Source text - English Marketing gurus and brand managers worldwide bemoan the erosion of customer loyalty. The global power of consumer brands is not what it was before, and marketers do not like it. They see their customers as fickle and ungrateful.
In reality, these marketers completely misunderstood the decline of brand loyalty. A review of the past decade reveals that customers have not been cavalierly unfaithful to established brands; quite the opposite.
But look at any typical block of TV network advertising in the US and you will see at least a quarter of the primetime advertisements show their target customers and prospects as idiots and fools. Their ‘innovations’ frequently add more complexity than value. Their willingness to apologize and compensate customers for errors or mistakes is nil.
And alternative marketing view is that ‘brand inertia’ far more than ‘brand loyalty’ is the reason why so many companies for so long. Those who switches are not being disloyal they are being discriminating in choosing brands.
The central marketing question confronting brand leaders therefore is not “how can we radically increase customer loyalty?” but “how can we radically increase our own loyalty to customers?”
This is where traditional marketing and brand advertising fail. Often, it is not the brand attribute of flawless service but the real-world performance in rapidly recovering from a mistake that wins customer loyalty and return business. Examples are legion: airline reservationists who waive “change fees” for inadvertently misbooked flights. Mobile telephone operators who politely and without complaint remove rightly disputed charges from the bill. These are less acts of “customer service” than demonstrations of loyalty to customers.

Rinkodaros ekspertai ir prekės ženklų vadovai visame pasaulyje patiria klientų lojalumo stoką. Pasaulinė vartotojų prekių ženklų galia nėra tokia, kokia buvo anksčiau, ir rinkodaros specialistams tokia situacija nepatinka. Savo klientus jie mato kaip nepastovius ir nedėkingus.
Tiesa ta, kad rinkodaros specialistai neteisingai suprato lojalumo nuosmukį prekės ženklui. Pastarojo dešimtmečio apžvalga atskleidžia, kad klientai nebuvo pasmerktinai neištikimi nusistovėjusiems prekių ženklams, o visiškai priešingai.
Tačiau pažvelkite į bet kurią tipišką JAV televizijos tinklo reklamos grupę ir pamatysite, kad bent ketvirtadalis populiariausių reklamų vaizduoja savo tikslinius bei potencialius klientus kaip idiotus ir kvailius. Jų „naujovės“ dažnai suteikia daugiau painiavos nei reikšmės. Jie nerodo pasiryžimo atsiprašyti savo klientų bei taip pat suteikti kompensaciją dėl padarytų klaidų.
Alternatyvus rinkodaros požiūris yra tas, kad „prekės ženklo inercija“ yra daug daugiau nei „lojalumas prekės ženklui“ yra priežastis, kodėl tiek daug įmonių taip ilgai(?neužbaigtas sakinys/mintis). Tie, kurie keičiasi, nėra nelojalūs, jie yra diskriminuojami rinkdamiesi prekių ženklus. (originaliame tekste yra skyrybos klaidų)
Todėl pagrindinis rinkodaros klausimas, su kuriuo susiduria prekės ženklų lyderiai, nėra „kaip mes galime iš esmės padidinti klientų lojalumą?“ bet „kaip būtent mes galime iš esmės padidinti savo lojalumą klientams?“
Būtent šioje vietoje tradicinė rinkodara ir prekės ženklo reklama žlunga. Dažnai, tai tai ne prekės ženklo nepriekaištingo aptarnavimo požymis, o realūs rezultatai, kurie greitai atsigauna po klaidos ir laimi klientų lojalumą bei sugrąžina verslą. Pavyzdžių yra daugybė: aviakompanijos rezervuotojai, kurie atsisako „keitimo mokesčių“ už netyčia klaidingai užsakytus skrydžius. Mobiliojo ryšio operatoriai, kurie mandagiai ir be priekaištų pašalina iš sąskaitos pagrįstai ginčijamus mokesčius. Tai parodo sumažėjusius „klientų aptarnavimo“ veiksmus, o ne lojalumo klientams demonstravimus.

su išimtinėmis Prekybos agento teisėmis vykdyti veiklą tam tikroje Teritorijoje
Uždaroji akcinė bendrovė „AAAA“, įsteigta ir veikianti pagal Lietuvos Respublikos įstatymus, toliau vadinama „Organizacija“, kuriai atstovauja direktorius, veikiantis pagal bendrovės įstatus, vienos šalies vardu, ir „AAAA“, įmonė, įsteigta ir veikianti pagal Rusijos Federacijos įstatymus, kuriai atstovauja generalinė direktorė, veikianti pagal bendrovės įstatus, kitos šalies vardu, sudarė šią sutartį dėl tokio dalyko:
1. SUTARTIES DALYKAS
1.1. Prekėmis šioje sutartyje laikomos Prekės „xxx“.
1.2. Teritorija šioje sutartyje laikoma Rusijos Federacijos teritorija.
1.3. Organizacija suteikia, o Platintojas prisiima išimtines teises parduoti Prekes šios sutarties 1.2 p. nurodytoje Teritorijoje.
1.4. Išimtinės teisės reiškia, kad:
1.4.1. Organizacija įsipareigoja parduoti Prekes „xxx“, kurios bus platinamos Rusijos Federacijoje, išimtinai Platintojui. Prekės nebus parduodamos jokiai kitai įmonei, norinčiai prekiauti Prekėmis nurodytoje teritorijoje.
1.4.2. Platintojas įsipareigoja neprekiauti Prekėmis kokioje nors kitoje šalyje, išskyrus šalį, nurodytą šioje Sutartyje, t. y. tiktai Rusijos Federacijoje.
1.4.3. Jeigu Organizacijai atsirastų poreikis pateikti Teritorijoje kitas Prekes, ji įsipareigoja informuoti apie tai Platintoją, kad tos Prekės galimai būtų įtrauktos į šios sutarties 1.1 p. nustatytų Prekių sąrašą.
1.5. Organizacija parduoda, o Platintojas perka Prekes. Organizacija, gavusi apibrėžtos apimties Prekių užsakymą Sutartyje nustatyta tvarka, įsipareigoja perduoti jas Platintojo nuosavybėn, o Platintojas, Sutartyje nustatyta tvarka ir terminais įsipareigoja priimti Prekes ir už jas sumokėti.
1.5. Prekių tara atitinka reikalavimus, taikomus jai Europos Sąjungoje.
1.6. Ši Sutartis jos veikimo laikotarpiu yra pagrindas daugkartiniam Prekių pirkimui-pardavimui.
1.7. Prekių pardavimo Platintojui momentu Prekės neįkeistos, neareštuotos, jos taip pat nėra trečiųjų asmenų teisminių ginčų objektas.

A private limited liability company "AAAA", established and operating under the laws of the Republic of Lithuania, hereinafter referred to as the "Organization", represented by a director, who is acting in accordance with the company's statutes, on behalf of one party, and "AAAA", a company, established and operating under the laws of the Russian Federation, which is represented by the general director, acting in accordance with the company's statutes, on behalf of another party, entered into this agreement regarding the following matter:
1. SUBJECT OF THE TREATY
1.1. The Goods in this treaty are the “xxx” Goods.
1.2. The territory in this agreement is considered the territory of the Russian Federation.
1.3. The Organization grants, while the Distributor undertakes exclusive rights to sell the Goods in the specified Territory pursuant to clause 1.2 of this treaty.
1.4. Exclusive rights mean that:
1.4.1. The Organization is committed to sell the “xxx” Goods, which will be distributed in the Russian Federation, exclusively to the Distributor. The Goods will not be sold to any other company wishing to sell the Goods in the specified territory.
1.4.2. The Distributor is committed not to sell the Goods in any other country, except the country that is specified in this treaty, only in the Russian Federation.
1.4.3. If the Organization needs to present other Goods in the territory, it undertakes to inform the Distributor about this, so that those Goods may be included to the set list of Goods in clause 1.1 of this treaty.
1.5. The Organization sells and the Distributor buys the Goods. The organization, that has received a defined scope order of Goods in accordance with the procedure specified in the treaty, undertakes to transmit them to the ownership of the Distributor, and the Distributor undertakes to accept the Goods and pay for them in accordance with the procedure and terms specified in the treaty.
1.5. The packaging of the goods complies with the requirements applicable to it in the European Union.
1.6. This Agreement shall form the basis for multiple purchases and sales of the Goods during its term.
1.7. At the time of the sale of the Goods to the Distributor, the Goods are not mortgaged, pledged or encumbered, nor are they
subject to third party litigation.
