Una recentissima sentenza della Corte di Cassazione allarga la nozione di elusione tributaria (Cass. 17 ottobre 2008, n. 25374, disponibile sul sito ww.cortedicassazione.it).
La sentenza è un punto di riferimento importante per chi deve prendere decisioni fiscalmente rilevanti.
E' inoltre una decisione che si segnala anche all'interesse generale, perché riconosce la cogenza, al di fuori della materia tributaria, del divieto di abuso delle forme.
I principi fondamentali affermati dalla Corte di Cassazione
Secondo la Corte di Cassazione nel nostro ordinamento tributario esiste una norma non scritta, di origine comunitaria, che vieta di ricorrere a pratiche abusive per finalità di risparmio di imposta.
Per giungere a questa conclusione la Cassazione si è rivolta alla Corte di Giustizia CE chiedendo di confermare e rifinire il concetto di abuso del diritto già oggetto del leading case Halifax (Corte di Giustizia 21 febbraio 2006, C-255/02, disponibile alla pagina http://curia.europa.eu/jurisp/cgibin/form.pl?lang=it).
Nella sentenza Halifax la Corte di Giustizia aveva affermato che per pratica abusiva si deve intendere la struttura negoziale formalmente rispettosa delle norme scritte ma in grado di procurare un vantaggio fiscale contrario agli obiettivi che le norme perseguono (cfr. per una più ampia elaborazione del concetto, Corte di Giustizia 21 febbraio 2006, C-255/02 cit.).

A very recent verdict from the Court of Cassation has widened the notion of Tax Avoidance (Cass. 17 October 2008, no. 25374, available online at www.cortedicassazione.it).
The verdict is an important point of reference for those who have to make important tax decisions.
It is above all a decision that also appeals to general interest, as it recognizes the obligation, outside of tax matters, of the prohibition of abuse of law.
The Court of Cassation's main fundamental judgments
According to the Court of Cassation, an unwritten norm, of European origin, exists in our tax system which prohibits resorting to abusive practices in order to make tax savings.
To reach this conclusion the Court of Cassation referred to the Court of Justice of the European Communities, asking them to confirm the concept of abuse of rights which was already the subject of the leading case Halifax (Court of Justice, 21 February 2006, C-255/02, available online at http://curia.europa.eu/jurisp/cgi-bin/form.pl?lang=en ).
In the Halifax verdict the Court of Justice had declared that the concept of abusive practice must be interpreted as a transaction formally respectful of the written norms, but able to obtain a tax advantage contrary to the aims pursued by the norms (for further elaboration on the concept, please refer to the Court of Justice of the European Communities, 21 February 2006, C-255/02 cit.).

Hoffman Soto, stretto collaboratore fin dal 1978 di Anna Halprin, ha sviluppato "The Performance Lab" negli ultimi 15 anni al Tamalpa Institute di San Francisco. Insegna anatomia del movimento presso il New College of California, e tiene corsi in Europa, Australia e Nuova Zelanda.
Anna Halprin, pioniera della danza contemporanea e della danzaterapia, fondatrice del San Francisco Dancer's Worshop. Ha fondato nel 1978, con sua figlia Daria Halprin, il Tamalpa Institute, San Francisco.
The Performance Lab si articola in tre giornate di lavoro intenso, dalla mattina fino al tardo pomeriggio ed esplora vari aspetti del lavoro creativo e terapeutico. Nello specifico si basa sullo studio del movimento rituale, del metodo Life/Art Process e delle tecniche della messa in scena (Performance).
Movimento Rituale:
Approccio sistematico al movimento creato da Anna Halprin al San Francisco Dancer's Workshop. Si pratica a terra ed intende sviluppare la consapevolezza corpo/mente, la flessibilità, la fluidità e la longevità.
Life/Art Process:
Letteralmente "Il processo tra la Vita e l'Arte".
E' un percorso artistico, creativo e terapeutico che utilizza vari medium artistici quali il movimento, come linguaggio del corpo, il disegno come forma visiva delle emozioni.
Performance:
Lavoro sulla messa in scena attraverso l'uso del movimento, della voce, della parola. I partecipanti sono incoraggiati ad attingere alla propria storia e ai miti personali.

Il seminario si rivolge a danzatori, attori, educatori, terapeuti e a tutti coloro che sono interessati al movimento, suono, parola come possibilità creativa/terapeutica
Il seminario avrà inizio la sera di giovedì 16 luglio 2009; dalle ore 17,30 è prevista la registrazione dei partecipanti, alle ore 19,00 la cena d'incontro seguita da una presentazione del lavoro e del conduttore
Domenica 19 Luglio il seminario si concluderà nel pomeriggio.

Hoffman Soto, close collaborator of Anna Halprin until 1978, has been developing "The Performance Lab" over the last 15 years at the Tamalpa Institute of San Francisco. He teaches anatomy of movement at the New College of California, and holds courses in Europe, Australia and New Zealand.
Anna Halprin, pioneer of contemporary dance and dance therapy, is the founder of the San Francisco Dancer's Workshop. In 1978 she founded the Tamalpa Institute, San Francisco, with her daughter Daria Halprin.
The Performance Lab consists of three days of intensive work, from the morning until late afternoon, and it explores various aspects of creative and therapeutic work. Specifically it is based on the study of ritual movement, the Life/Art Process method and mise-en-scène techniques (Performance).
Ritual Movement:
A systematic approach to the movement created by Anna Halprin at the San Francisco Dancer's Workshop. The movement is practised on the floor and is intended at developing the awareness of the body and mind, as well as developing flexibility, fluidity and longevity.
Life/Art Process:
It literally refers to "the process between life and art".
It is an artistic, creative and therapeutic journey which uses the various artistic mediums of movement, as body language, and drawing, as a visible form of the emotions.
Performance:
Work on the mise-en-scène through the use of movement, the voice and words. The participants are encouraged to draw on their own experience and personal myths.
General information:
The workshop is aimed at dancers, actors, teachers, therapists and anyone who is interested in movement, sound and word as creative/therapeutic possibilities.
The workshop will begin the evening of Thursday 16th July 2009. Registration of participants will take place from 5.30pm, followed by the welcome meal at 7pm, and then a presentation of the work and the leader.
The workshop will finish the afternoon of Sunday 19th July.

Pratiche fisiche: Yoga e ginnastica Noguci. Ascolto e recupero del movimento che risuona in una parte del corpo sempre in connessione con le altre parti del corpo, stando in relazione con la gravità.
La Camminata: neutra e con immagini.
Improvvisazione: ricerca del punto di partenza del movimento e della motivazione di danzare le varie fasi della vita e gli elementi naturali. Come e perché si muovono: il vento, il fuoco, l’uccello, il gatto e il serpente...?
Come e perché il corpo si muove nel dolore, nella gioia, nell’amore, nella rabbia, nella disperazione?
Yuko Ota è una danzatrice che vive tra Giappone e Francia, nata nel 1977 a Fukuoka (Giappone). Nel 1999 incontra Atsushi Takenouchi e da allora segue seminari con numerosi maestri Butoh: Yoshito Ohno, Toru Iwashita, Tenko Ima. Entra a far parte della compagnia Globe Jinen diretta da Atsushi Takenouchi.
Collabora con Spazio Nu - Danza e Movimento di Pontedera Pisa, creando performance e conducendo workshop.

Butoh (“bu” significa danza e “toh” significa piede) nasce in Giappone intorno agli anni 50. Ha tante forme e facce infatti il Butoh mescola varie forma artistiche quali la danza, il teatro, l’improvvisazione. Alcuni aspetti del butoh sono la nudità del ballerino, il corpo dipinto di bianco, le smorfie grottesche ispirate al teatro classico giapponese, l'alternarsi di movimenti estremamente lenti con convulsioni frenetiche. Non esiste una messa in scena tipica del butoh. I suoi fondatori sono i due danzatori Kazuo Ohno e Tatsumi Hijikata.

Physical practice: Noguci yoga and gymnastics. Listening to and retrieval of the movement which resonates in a part of the body that is always connected to the other parts of the body, staying in touch with gravity.

Improvisation: the search for the starting point of movement and of the motivation to dance the various phases of life and the natural elements. How and why do wind, fire, birds, cats, snakes (etc.) move? How and why does the body move in pain, in joy, in love, in anger, in desperation?
Yuko Ota is a dancer who lives between Japan and France. She was born in 1977 in Fukuoka, Japan. In 1999 she met Atsushi Takenouchi and has since followed workshops with numerous Butoh masters such as Yoshito Ohno, Toru Iwashita and Tenko Ima. She is part of the company Globe Jinen, directed by Atsushi Takenouchi, and she also collaborates with the group Spazio Nu - Danza e Movimento di Pontedera Pisa (Dance and Movement of Pontedera Pisa), creating performances and conducting workshops.

Butoh ("bu" means dance and "toh" means foot) was born in Japan around the 1950s. It has many forms and faces, in fact Butoh mixes together the various artistic forms of dance, theatre and improvisation. Some aspects of Butoh include the nudity of the dancer, the body painted white, grotesque grimaces inspired by classical Japanese theatre and the alternating between extremely slow movements and frenetic convulsions. No typical Butoh mise-en-scène exists. Its founders are the dancers Kazuo Ohno and Tatsumi Hijikata.
