Source text - Spanish El Banco Central dispuso la obligatoriedad de incluir en las órdenes de transferencias de fondos y mensajes conexos información de identificación del ordenante de la transferencia
El 14 de julio de 2009 el Banco Central de la República Argentina dictó la comunicación “A” 4965 que dispone la obligatoriedad de incluir en las transferencias de fondos al exterior y en los mensajes conexos la siguiente información, como mínimo, del ordenante: nombre completo y denominación social, domicilio o número de identidad nacional o CUIT, y número de identificación del cliente en la entidad ordenante.
En caso de que la información mencionada en el párrafo precedente no conste en las órdenes de transferencias provenientes del exterior, las entidades financieras deben mantener los fondos pendientes de liquidación hasta un plazo de 20 días hábiles desde la recepción de la transferencias de fondos hasta tanto se subsane la omisión. Vencido dicho plazo, corresponderá devolver los fondos al emisor.
Destacamos que deberá prestarse especial atención a todas las transferencias de fondos que se cursen (ingresos por exportaciones de bienes y servicios, prefinanciación y anticipos de exportaciones, aportes y asignaciones de capital, préstamos, repatriación de fondos propios, etc.) dado que si los datos del ordenante no se incluyen en la correspondiente orden de transferencia los fondos no podrán liquidarse en el mercado de cambios. Por ello, sugerimos conversar con los bancos con los cuales se liquiden las divisas sobre el cumplimiento de esta norma antes de ingresar los fondos al mercado de cambios.
Translation - English The Central Bank set forth as mandatory the inclusion of the fund transfers orders and the messages related to identification data of the transferor
On July 14, 2009, the Argentine Central Bank issued Communication “A” 4965 setting forth as mandatory the inclusion of the fund transfers abroad and the messages related to the following information of the transferor: full name and corporate name, domicile or ID number or CUIT (Tax Identification Number), and the customer identification number within the transferor entity.
In case the information detailed above is not mentioned in the transfer orders from abroad, the financial entities shall keep the settlement of the funds pending for a term of up to 20 business days as from the reception of the fund transfers until the omission is rectified. Once said term is due, the funds shall be returned to the issuer.
Special attention should be paid to all the fund transfers in process (incomes due to goods and services exports, pre-financing and advances on exports, equity contributions and allocations, loans, repatriation of personal funds, etc.) because, if the transferor data is not included in the fund transfer order, said funds would not be settled at the exchange market. Therefore, we suggest discussing with the banks where the foreign currency is being liquidated about the compliance of this regulation before entering the funds into the exchange market.
