Об утверждении Правил государственной регистрации
и государственного учета международных договоров

На основании Федерального закона от 15.07.95 N 101-ФЗ "О международных договорах Российской Федерации" (Собрание законодательства Российской Федерации, 1995, N 29, ст.2757) и в соответствии с Указом Президента Российской Федерации от 11 июля 2004 года N 865 "Вопросы Министерства иностранных дел Российской Федерации" (Собрание законодательства Российской Федерации, 2004, N 28, ст.2880; 2005, N 19, ст.1782; N 43, ст.4371; 2007, N 5, ст.637)
приказываю:
1. Утвердить прилагаемые Правила государственной регистрации и государственного учета международных договоров Российской Федерации.
2. Контроль за исполнением настоящего приказа оставляю за собой.

ПРАВИЛА
государственной регистрации и государственного учета
международных договоров Российской Федерации
I. Общие положения
1.1. Настоящие Правила устанавливают последовательность действий Министерства иностранных дел Российской Федерации (далее - Министерство), совершаемых при государственной регистрации и государственном учете международных договоров Российской Федерации (далее - договоры).
1.2. Государственная регистрация и государственный учет составляют Единую государственную систему регистрации и учета международных договоров Российской Федерации (далее - ЕГС).
1.3. В соответствии со статьей 26 Федерального закона от 15.07.95 N 101-ФЗ "О международных договорах Российской Федерации" (Собрание законодательства Российской Федерации, 1995, N 29, ст.2757) ЕГС находится в ведении Министерства.
1.4. Государственной регистрации подлежат договоры, вступившие в силу для Российской Федерации.
1.5. Государственному учету подлежат зарегистрированные договоры. Равным образом государственному учету подлежат не вступившие для Российской Федерации в силу подписанные договоры, либо договоры, в отношении которых Российская Федерация выразила свое согласие на обязательность в иной, нежели подписание, форме, предусмотренной международным правом и законодательством Российской Федерации (ратификация, утверждение, принятие, присоединение).
1.6. Ведение государственной регистрации и государственного учета договоров осуществляет Правовой департамент Министерства.
II. Государственная регистрация договоров
2.1. Государственная регистрация осуществляется путем присвоения договору регистрационного номера в электронной учетной карточке договора. Регистрационный номер присваивается договору Правовым департаментом Министерства в течение 10 рабочих дней с даты получения им документов (нот, писем и т.п.), подтверждающих вступление договора в силу для Российской Федерации.
2.2. Регистрационный номер на подлиннике договора или его заверенной копии не проставляется.

On the basis of Federal Act No.101-FZ of 15.07.95 “On International Agreements, that the Russian Federation is a Party to” (Collection of legislation of the Russian Federation, Art. 2757, No.29 of 1995) and in compliance with the Edict of the President of the Russian Federation No.865 of July 11, 2004 “Issues within Jurisdiction of Ministry for Foreign Affairs of the Russian Federation” (Collection of legislation of the Russian Federation Art. 2880, No.28 of 2004; Art.1782, No.19, Art.4371, No.1782 of 2005; Art. 637, No.5 of 2007)
I hereby order:
1.To approve the enclosed Rules for state registration and recording of international agreements, that the Russian Federation is a party to.
2.I reserve for myself the control of execution of this Order

RULES
for State Registration and Registering of the International Agreements
that the Russian Federation is a Party to
I. General Provisions
1.1. These Rules stipulate the sequence of actions, which the Russian Federation
Ministry for Foreign Affairs (hereinafter referred to as the Ministry) is to fulfil for state registration and recording of the international agreements, that the Russian Federation is a party to (hereinafter referred to as agreements).
1.2.State registration and recording shall comprise a Uniform State System for Registration and Recording of the international agreements, that the Russian Federation is a party to (hereinafter referred to as ESS).
1.3.In compliance with Article 26 of the Federal Act No.101-FZ of 15.07.95 “On the International Agreements, that the Russian Federation is a Party to” (Collection of legislation of the Russian Federation, Art. 2757, No.29 of 1995), ESS falls within jurisdiction of the Ministry for Foreign Affairs.
1.4.The agreements enforced within the Russian Federation are subject to state registration.
1.5.Registered agreements are subject to state recording. Subjects to records are also signed but not enforced within the Russian Federation agreements, or those agreements, recognized mandatory by the Russian Federation although unsigned, but ratified, adopted or adhered to, as stipulated by international law and law of the Russian Federation.
1.6.Legal Department of the Ministry shall be responsible for state registration and recording of agreements.
II. State Registration of Agreements
2.1.State registration shall imply allocation of serial number in electronic record card. The registration number shall be allocated by Legal Department of the Ministry within 10 working days since the documents (notes, letters etc.), confirming enforcement of the agreement within the Russian Federation, have been received.
2.2.Serial number shall be put down neither to original nor to certified copy of the agreement.
