Swedish term

pantsättning / inteckning?

Swedish to English Bus/Financial Real Estate
Can anyone explain the difference between pantsättning / pantbrev and inteckning? Are these not all "mortgages"?

Swedish term (edited): pantsättning / (fastighets) inteckning > pantbrev
Selected

collateralis#zation/ (land) charge > mortgage deed

Pantbrev: mortgage deed, issued as evidence of an 'inteckning': Juridikens termer. Almqvist & Wiksell (A&W).

Företagsinteckning: to my knowledge, is a *floating* charge if taken by a company over unfixed assets and goods e.g. viss lös egendom (A&W). The pantbrev in E&W (Can?) would then be called a *debenture*

A fixed charge would, in the UK, be taken by companies or partnerships over land.

Hypothecation: possession remains with the borrower: Barron's US Law Dictionary. Care needs to be taken as would work for land in the US, but not for the UK (CanE?) where it is used for ships and their cargo only.

Charge: to impose a lien or claim; to encumber the land with a tax lien (US only): A Handbook of (US) Business Law, Bryan A. Garner.

Lien: in the US, can be of land. In the UK, of movable goods (motor vehicles), chattels and co. shares only.

Pledge or pawn: of movable goods.

Otherwise, look at the footnote in English Private Law, Property Law, OUP.

PS ytterligare inteckning > there can be a further charge (2nd or 3rd etc.) over the property but not pantsättning.

Thanks, both are variations thereof and not pledge for land.
