Discussion

philgoddard Oct 29, 2010:
Just for information, "the same" often simply means "it". It's pompous, legalistic English.
Tony M Oct 29, 2010:
Meaning "You will be responsible (à votre charge ?) for being unable to complete the supply, the system on time, or if any penalty has to be paid due to your delay"

the same = what has just been talked about, 'the foregoing'

I think if you turn it round to produce a more natural word order in FR (« les ..... seront à votre charge »), then the need for the term will disappear altogether.

Not that this liabaility is not simply the payment of any penalties (that's just one of the list items), but overall liability for the delays (which might include liquidated damages, consequential damages and goodness knows what else as well).

I would sort of have expected to read "You will be held responsible for...", but I guess that's simply a question of style, and doesn't really have much bearing on the actual translation here.
Nothing to do with in the 'same way' or 'likewise' (= également, etc.)

tout non-respect des délais de réalisation ou de livraison...

...ainsi que toute pénalité à verser qui en découle, seront imputés à votre charge

I am very reluctant to express myself in my very inadequate FR, but this is the only way I can convey the general idea as I am interpreting it.

Corrections, please!

agree Andrew Bramhall : Like your 'explanation' solution even better than your caption answer. Sometimes you're too modest about your French abilities!///Unlike your hair, then, obviously !

Merci, Oliver ! It tends to avoid flaming... ;-)
agree zaleb (X) : Vous serez tenu responsable de tout retard apporté à la réalisation ou à la livraison (de...?), de même que vous serez redevable de toute pénalité qui en découlerait.

Merci, T F !
agree mimi 254 : agree with "ainsi que" which best renders the idea of "for same"//ainsi que de toute pénalité y relative

Merci beaucoup, Mimi !
agree FX Fraipont (X) : Note : I have serious reservations about "imputés à votre charge". I think it's either "seront à votre charge" or "vous seront imputés".

(Vous serez responsable de) Remboursement pour une valeur de...

ce dont il s'agit.
Peer comment(s):

neutral Tony M : But it my not just be 'remboursement', but a whole range of possible consequences...

Yes, point taken- but it probably means financial recompense as the bottom line...

tu en porteras aussi la responsabilité

il/elle est responsable du retard et s'il y a des pénalités à payer à cause du retard, il/elle les paie/endosse

en d'autres termes: tu seras aussi responsable du paiement des éventuelles pénalités
Peer comment(s):

neutral Tony M : It's not just paying the penalties, it's everything; and I feel quite sure 'tu' would be quite the wrong register here! / No 'same' isn't being used that way in EN here, it's a special usage common in commercial EN

agree for wrong register! the supplier is responsible for delay and also reponsible for eventual penalties - so for same actuallly means "also" here IMHO//OF COURSE YES! If not what is the difference b/w your "ainsi que" and "also" or "aussi"?
