L'espressione suggerisce una certa incertezza o indecisione da parte del Tribunale e quindi quanto detto di seguito (che non hai riportato) probabilmente dovrebbe sottolineare una certa indecisione sul da fare. La tradurrei quindi con "Il Tribunale e' del parere che/ritiene che/ Si presume che". Nel sito riportato ho trovato la stessa espressione che suggerisce quanto ho appena detto.
Nel secondo sito riportato invece il senso e' piu' vicino al nostro " visto che.../ considerando che..." e viene ripetuto spesso nel testo, ergo la scelta dipende molto dal tenore di quello che viene affermato dopo "as follows"
