English term

proximate cause of the accident or occurrence herein..

English to Spanish Law/Patents Law (general) Legal documents for law firm in USA.
I would like to know the best translation of this phrase from American English into Latin American Spanish.

Colleagues from Spain, feel free to send me your suggestions as well. Is okay to translate it as proxima causa del accidente o ocurrencia aquí dentro?

It's a translation about a legal case for Latin People living in The United States and Americans readers.

Here is the full paragraph:

The negligence of those responsible for the accident or the occurrence alleged in
the Complaint constituted a separate, independent, superseding, intervening culpable act or acts which constitute the sole proximate cause of the accident or occurrence herein..

You are welcome, and please apologize for the typo: it reads ocurrencie, it must read occurence.
yugoslavia (asker) Jun 5:
Gracias Muchas gracias Luis.
Luis M. Sosa Jun 5:
ocurrencie: ocurrencia same dictionary

Accident or occurrence would be better translated as "accidente o incidente" or perhaps "accidente o suceso," since the most common meaning of "ocurrencia" in Spanish is "dicho agudo u original," being a synonym of "idea", "agudeza", "gracia", "chiste", "ingeniosidad", etc.

Thanks Miss Browers, what will be the best translation for occurrence herein? Thanks again. Yugoslavia

English term (edited): the sole proximate cause of the accident or occurrence herein alleged

el único nexo causal entre el daño y el siniestro o incidente alegado en el presente recurso

My problem with 'causa' is that it doubles as contract consideration, so - in this case - a proximate quid pro quo.
Example sentence:

IATE: health COM en proximate cause COM es causa próxima

El nexo causal es un concepto fundamental en el campo del derecho.

Thanks for your help Adrian. I appreciate it. Yugoslavia

causa inmediata del accidente o siniestro

Hola, yo soy de España.
No sé si te ayudará mucho.
Saludos.

"La OMS recomienda que en la cumplimentación de las causas de defunción se comience por la causa inmediata y se termine por la causa , es decir, en un orden natural de arriba hacia abajo, respondiendo a las palabras que facilitan la comprensión del concepto de secuencia lógica, tan importante para la selección de la Causa Básica de Defunción.
