durch die Zollbehörde in Anspruch genommen

Sofern FIRMA A trotz der in Absatz 1 genannten Verpflichtung oder wegen einer von FIRMA B veranlassten Herausgabe von Ladeeinheiten, z.B. als Betreiber der Umschlaganlage oder auf Grund der Eintragung als Zollamtsplatz, durch die Zollbehörde in Anspruch genommen wird, stellt FIRMA A von sämtlichen Zahlungsverpflichtungen auf Grund eines etwaig erlassenen Steuerbescheides auf erstes Verlangen frei. Das gilt nicht, sofern eine Inanspruchnahme von FIRMA A verschuldet ist.

Taken from an agreement on "Zollabwicklung" between two transport companies. Can anyone work out what they mean by "durch die Zollbehörde in Anspruch genommen" and "eine Inanspruchnahme von .... verschuldet ist"?

This is an indemnity clause The general gist is as follows ...

If company A [notwithstanding the obligation set out in paragraph 1 or on account of a surrender/release of cargo units initiated/caused by company B, for example in the capacity of operator of a transhipment site or resulting from registration as customs premises] is subject to a claim/assessment by the customs authorities, company B shall indemnify company A on a first request for all payment demands resulting from any tax assessment.

I think there must be something missing in the text you have written. In the second half of the clause "stellt FIRMA A von sämtlichen Zahlungsverpflichtungen ..." It should be "stellt FIRMA B FIRMA A von ..." It has to say who is indemnifying whom. From the logic of the sentence it has to be company B which is indemnifying company A. This is backed up by the second sentence which says that the indemnity does not apply if company A is responsible for the fact that the customs authorities are making demands of it.

A layman would say the firm is charged by customs, or a claim is laid on the firm. But I leave such matters to the experts!

@asker could it be "...durch die die Zollbehörde in Anspruch genommen wird...", i.e. that the article 'die' is missing in your text (...through which the...)
