La cour fédérale Chaoyang de Pékin a accepté d'ouvrir un procès où le plaignant sera l'artiste Ai Weiwei. Celui-ci accuse le gouvernement chinois de violer la loi en lui imposant 2,4 millions de $ d'intérêts pour fraude fiscale.
L'ouverture du procès est déjà un premier pas dans la bataille que mène l'artiste pour obtenir justice pour la société qui a contribué à produire ses œuvres, Beijing Fake Cultural Development Ltd. Les cours chinoises acceptent dans de rares cas que les dissidents portent plainte contre le gouvernement.
Dans une interview téléphonique accordée à Reuters, le lendemain de l'annonce du procès, Ai Weiwei se disait réservé quant au tournant que pouvait prendre l'affaire : « Il faudrait que la cour fasse un verdict sans tenir compte de l'interférence du bureau fiscal et de la sécurité publique ».
L'avocat de la société, Pu Zhiqiang, a également répondu aux questions de Reuters. Il a expliqué que les autorités n'avaient produit aucun original qui prouve la fraude fiscale. Il a ajouté qu'il considérait comme une violation de la loi l'audition à huis clos tenue en juillet dernier.
Pour l'instant, aucune date pour le procès n'a été retenue, mais on sait déjà qu'Ai Weiwei n'a pas l'autorisation d'y assister. Son épouse, Lu Qing, représentante légale de la société, y a droit.
Cette décision intervient quelques jours seulement après le coup d'éclat de l'avocat activiste aveugle Chen Guangcheng, qui a échappé à son assignation à domicile et a cherché refuge à l'ambassade américaine.

The Beijing's Chaoyang District Court accepted a case whose plaintiff will be the artist Ai Weiwei. He accuses the Chinese government of violating the law by imposing him a $2.4 million tax evasion penalty.
The trial’s opening is already a first step in the legal battle the artist is waging to gain justice for Beijing Fake Cultural Development Ltd, the company that marketed his works. Chinese courts rarely accept lawsuits filed by dissidents against the government.
In a telephone interview given to Reuters, the day following the trial’s announcement, Ai Weiwei claimed to be unsure of how the case could evolve: “I hope that they can make an independent verdict, but due to the interference of the tax bureau and the public security (bureau), it is difficult to say”.
The company's lawyer, Pu Zhiqiang, also answered Reuters’ questions. He explained that the authorities had not shown him any original documents with evidence of the alleged tax evasion. He added that, according to him, the closed hearing held on last July was violating the law.
So far, no trial date has been set but we already know that Ai Weiwei will be barred from attending it. His wife, Lu Qing, the firm’s legal representative, will be present.
This decision comes just days after the remarkable feat by blind legal activist Chen Guangcheng who escaped his house arrest and sought refuge in the U.S. embassy.

Source text - French Portland to host its 10th Time-Based Art Festival
Portland, 10 August 2012, Art Media Agency (AMA).
From 6-16 September, the Portland Institute for Contemporary Art in Oregon will be hosting its tenth Time-Based Art Festival.
This year’s festival will feature performance, theatre, dance, films, and music works by local and international artists and will take place in several venues throughout the city.
Featured works include a rock ‘n’ roll documentray The Love Song of R. Buckminster Fuller, dedicated to the utopian designer, the political work Dirtday! by local artist Laurie Anderson, and choreographer Miguel Gutierrez’s comic monologue and dance.
Visual art curator, Kristan Kennedy, is reported by the Art Newspaper as saying “the artists are often in the room and the audience is invited to be in concert with them”. One example is an interactive work performed by the Italian artist Alex Cecchetti who begins by telling a story using words, objects and drawings, which will then be retold throughout the festival by other artists, each passing the story onto the next.
“There’s a lot of risk and potential failure and that’s what’s pushed us forward in the festival”.
