Source text - French 2. ARTICLE 2 - OBJET DU CONTRAT
Le marché principal, ci-après désigné le «Marché Principal», dont les caractéristiques sont les suivantes :
Type de marché principal : Marché public
Nature de l'opération : Terrassements, Ouvrages d'Art, Rétablissement des Communications (TOARC)
Pour lequel l'Entreprise Principale est Titulaire.
Dans ce cadre, l'Entreprise Principale confie au Sous-traitant par le présent contrat de sous-traitance, ci-après «le Contrat», les travaux et prestations suivants :
Etudes de conception et d'exécution,
Réalisation de renforcement de sol par Trenchmix et inclusions rigides de type CMC,
Suivi et contrôle qualité.
Désignés ci-après les «Travaux».
Ces derniers sont à exécuter sur le site où les Ouvrages doivent être réalisés, ci-après désigné comme étant le «Chantier».
La définition, la description des ouvrages, la consistance des Travaux et de leurs spécifications techniques sont indiquées dans les pièces techniques du Contrat.
3. ARTICLE 3 - PIECES CONTRACTUELLES
Les documents constitutifs du présent Contrat de sous-traitance sont listés aux articles 3.1 à 3.2.

3.1.2.
Documents particuliers opposables au seul Sous-traitant (ou Engagements unilatéraux)
A l'appui de son offre, le Sous-traitant a présenté les documents suivants qui constituent des Engagements unilatéraux de sa part et dont l'Entreprise Principale peut exiger le strict respect
En revanche, ces Engagements unilatéraux ne confèrent pas de droit au Sous-traitant, de sorte qu'il ne pourra s'en prévaloir d'une quelconque manière.

CONFIDENTIEL
La Réclamation présentée par le Sous-traitant doit contenir un exposé clair des motifs et formuler les demandes en termes techniques, de coût et de délai d'exécution de manière précise et justifiée.
Toute Réclamation présentant la forme d'une réserve générale est considérée comme sans effet
8.4.
Représentation
Le Sous-traitant s'engage à désigner une personne habilitée à le représenter sur le Chantier dans les conditions définies à l'article 4-316 des Conditions Générales de la FNTP (version 2014}.
8.5.
Réumons de coordination et Réunions de Chantier
Le Sous-traitant s'engage à assister à toutes les réunions de coordination et aux réunions de chantier auxquelles l'Entreprise Principale l'aura invité.
L'Entreprise Principale lui transmet un compte-rendu de réunion, ou, s'il s'agit d'une réunion en présence du Maître d'Ouvrage et/ou du Maître d'Œuvre, l'extrait du compte-rendu établi par le Maître d'Œuvre concernant les travaux effectués oar le Sous-traitant et concernant tous les autres travaux pouvant avoir un impact sur les travaux du Sous- Traitant...
Le Sous-traitant fait part de ses éventuelles observations sur ies comptes rendus de réunion à l'Entreprise Principale :
dans un délai permettant à cette dernière de respecter ses propres obl;gat!ons au tjtre du Marché Principal, s'il s'agit d'un compte-rendu de réunion relative au Marché principal,
dans un délai de cinq jours calendaires à compter de la réception par le Sous-Traitant du compte-rendu, dans les autres cas,
Passé ces délais,, 'e compte-rendu de réunion correspondant sera réputé avoir été acceoté sans observation ni réserve par le Sous-Traitant
Translation - English 2. ARTICLE 2 – PURPOSE OF THE AGREEMENT
The principal contract, hereinafter referred to as the "Principal Contract", for which the characteristics are as follows:
Principal contract type: Public contract
Nature of the operation: Earthworks, Structure Engineering, Roadway Upgrades/Renovations (TOARC)
For which the Main Contractor is holder.
In this respect, the Main Contractor entrusts the Subcontractor by the present subcontracting agreement, hereinafter the "Agreement", the following works and services:
Design and implementation studies,
Realization of ground reinforcement via Trenchmix and CMC-type rigid inclusions,
Monitoring and quality control.
Hereinafter referred to as the "Work".
These are to be performed on the site where the Structures must be realized, hereinafter referred to as the "Work Site".
The definition, description of the structures, consistency of the Work and its technical specifications are indicated in the technical parts of the Agreement.
3. ARTICLE 3 – CONTRACTUAL PARTS
The documents constituting this Subcontracting Agreement are listed in articles 3.1 to 3.2.

3.1.2.
Specific documents binding the sole Subcontractor (or Unilateral Commitments)
In support of its offer, the Subcontractor presented the following documents that constitute Unilateral Commitments on its part and for which the Main Contractor may require strict compliance.
However, these Unilateral Commitments do not confer any right upon the Subcontractor, so that it cannot rely on it in any way.
These commitments are as follows:

CONFIDENTIAL
The Claim presented by the Subcontractor must contain a clear statement of reasons and formulate the requests in technical terms, cost and turnaround time in a precise and justified manner.
Any Claim presented in the form of a general reserve is considered ineffective.
8.4.
Representation
The Subcontractor commits to appointing a person authorized to represent it on the Site in accordance with the conditions defined in article 4-316 of the FNTP General Conditions (2014 version).
8.5.
Coordination Meetings and Site Meetings
The Subcontractor commits to assisting at all coordination meetings and site meetings to which it was invited by the Main Contractor.
The Main Contractor will provide meeting minutes, or, in the case of a meeting with the Project Owner and/or Project Manager, the extract from the minutes kept by the Project Manager concerning the work carried out by the Subcontractor and concerning any other work which could have an impact on the work of the Subcontractor...
The Subcontractor will express any comments it may have regarding the meeting minutes to the Main Contractor:
within a time frame allowing the latter to meet its own obligations under the Principal Contract, in the case of meeting minutes relating to the Principal Contract,
within five calendar days, starting from reception by the Subcontractor of the minutes, in other cases.
Beyond this time period, the corresponding meeting minutes will be considered as having been accepted without any comments or reservations by the Subcontractor.
