English to Lithuanian: Jurdgement Translation excerpt Detailed field: Law (general)
Source text - English The Issues in the Case
12. The local authority is seeking findings as set out in the further amended schedule of findings which I am not going to recite because they can simply be read but, essentially, that the injuries were inflicted head trauma, most probably involving shaking and that this was done by one or both of the parents non-accidentally and that if by one alone, the other parent failed to protect Kevinas from harm. The local authority no longer seeks a finding in relation to paragraph 8 of the schedule, the allegation that the parents did not seek timely medical attention for Kevinas.
13. As I have said, the parents have presented as a couple in that at least until written submissions, neither sought to attribute the injuries to the other, accepting that the father had given explanations which they together said provided accidental mechanisms for the retinal and subdural haemorrhages and the bruises.
14. The mother’s position is that she did not cause the subdural or retinal haemorrhages and that the account of the father at the hearing of having shaken Kevinas roughly on one occasion may account for those injuries, and that the marks or bruises were sustained in the accounts of accidental trauma that have been described by the father and by her.
