Source text - English The Management Board discussed that the change to a new system will have considerable implications on the national competent authorities and the EMEA. In order to minimise risks associated with changing the existing financing system and to fully understand implications of a new system, any new option has to be thoroughly analysed and tested before a final decision is taken.
In order to identify the new system, the Management Board decided to prepare and agree on generally accepted international costing methods referred to in Article 12 of the Fee Regulation. To achieve this, the Board has decided to continue the work of its costing group and asked the group to make a proposal to the Management Board before the end of this year. Andreas Pott was asked to chair the group. Representatives from all national competent authorities will be invited to participate in this work. Possible involvement of external consultancy services was discussed. The existing scale of fees will remain in force pending finalisation of a new decision.
The European Commission and the Executive Director reiterated their positions that the change to the scale of fees system has to be implemented as early as possible. The Commission reiterated that the final decision on the change be taken early in 2008.
Translation - Romanian Consiliul de administraţie a discutat faptul că trecerea la un nou sistem va aduce implicaţii considerabile privind autorităţile naţionale competente şi EMEA. În vederea minimalizării riscurilor legate de schimbarea sistemului financiar existent şi de a înţelege pe deplin implicaţiile noului sistem, orice opţiune nouă trebuie analizată şi testată în întregime înainte de luarea deciziilor finale.
Pentru a identifica noul sistem, Consiliul de administraţie s-a hotărât să elaboreze şi să fie de acord cu metodele de cost internaţionale acceptate referitoare la articolul 12 din Regulamentul de taxe. Pentru a realiza aceasta, Consiliul s-a hotărât să continue activitatea grupului său de cost şi a cerut grupului să facă o propunere Consiliului de administraţie înainte de sfârşitul anului. Andreas Pott a fost rugat să prezideze grupul. La aceste lucrări vor fi invitaţi să participe reprezentanţii de la autorităţile naţionale competente. S-a discutat o posibilă implicare a serviciilor de consultanţă externă. Baremul de redevenţă existent va rămâne în vigoare până la finalizarea unei noi decizii.
Comisia Europeană şi Directorul executiv au reiterat poziţiile lor că schimbarea sistemului cu barem de redevenţă trebuie implementat cât mai repede posibil. Comisia a reiterat că decizia finală asupra schimbării să fie luată la începutul anului 2008.

Source text - French Malgré ces atouts évidents, les modèles juridiques spécifiques des entreprises à lucrativité limitée ne sont pas encore reconnus par la législation européenne. Face à des entreprises cotées à but lucratif qui dominent la plupart des marchés, elles souffrent d’un handicap de compétitivité, d’un inégal accès au capital nécessaire à leurs investissements et à leur développement.
Par l’émission « gratuite » de titres sur les marchés actions, les entreprises à but lucratif accèdent au capital à des conditions favorables.
Les entreprises à lucrativité limitée n’ont pas le droit d’émettre des actions. Pour se financer, elles se reposent sur leurs capacités à constituer des excédents -souvent limités par leur raison d’être-, ou doivent recourir à l’emprunt à des taux dépassant souvent la moyenne du marché.
Les législations nationales ont longtemps permis de compenser ce handicap structurel aux moyens d’aides d’État (subventions, marchés réservés, mise à disposition gratuite de locaux, de personnels fonctionnaires ou fiscalités avantageuses). Au nom d’une conception inique de la concurrence, niant les externalités positives de ces entreprises, le droit européen est venu rétablir l’inégalité en leur interdisant toutes aides d’État.
Translation - Romanian În ciuda acestor atuuri evidente, modelele juridice specifice întreprinderilor cu profit limitat nu sunt încă recunoscute de legislaţia europeană. Puse în faţa societăţilor cotate cu scop lucrativ care domină cea mai mare parte a pieţelor, acestea suferă de un handicap de competitivitate, de un acces inegal la capitalul necesar pentru investiţiile şi dezvoltarea acestora.
Prin emisiunea „gratuită” de titluri pe pieţele de acţiuni, societăţile cu scop lucrativ au acces la capital în condiţii favorabile.
Întreprinderile cu profit limitat nu au dreptul de a emite acţiuni. Pentru a se finanţa, acestea se bazează pe capacităţile lor de a constitui excedente – adesea limitate prin forma lor de a funcţiona – sau trebuie să recurgă la împrumuturi la rate ale dobânzii care depăseşc adesea media pieţei.
Legislaţiile naţionale au permis un timp îndelungat compensarea acestui handicap structural prin ajutoare de Stat (subvenţii, pieţe rezervate, punere la dispoziţie a spaţiilor, a personalului funcţionar cu titlu gratuit sau fiscalitate avantajoasă). În numele unei concepţii inechitabile a concurenţei, care neagă externalităţile pozitive ale acestor societăţi, dreptul european a restabilit inegalitatea prin interzicerea oricăror ajutoare din partea Statului.
