Despite our view that the Agreement generally is binding, there are arguments of varying strength as to why specific clauses may or may not be enforceable. We feel that the operative clauses of the Agreement can be divided into three categories. On the one hand, there are those provisions that impose high-level co-operation obligations on the Parties, but do not include concrete definitions of the objectives to be achieved or set out the steps to achieve them. On the other, there are those clauses that impose specific obligations on the Parties in defined circumstances. Finally, there are obligations in the middle, which in turn can be sub-divided into those that provide for an agreed mechanism for resolving disagreements and those that do not.
