In primul rand, instanta se va pronunta cu privire la desfacerea casatorii prin divort sau nu, deci va admite sau nu actiunea. Daca admite actiunea, se va pronunta si cu privire la culpa procesuala, daca este vorba despre un alt tip de divort decat cel numit de lege prin acordul partilor. In acest sens, casatoria poate fi desfacuta din vina comuna a sotilor, din vina exclusiva a sotului parat sau din vina exclusiva a sotului reclamant-parat (daca s-a facut cerere reconventionala).
